Ebay problem

I'm after some advice, and I'm not sure if asking Ebay will help at all. Wondering if anyone has experience.

I ordered some boots from Australia. UPS tried to deliver but they wanted some stupid amount of money for VAT and brokerage surcharge. This part I’m not too worried about. Well that's a lie, the charges suck but its not so much the sellers fault (although they say the try to get the boots to the buyer VAT free!)

What I am worried about is that I saw the packaged and it was a pair of boots wrapped in a plastic bag, not the original box. I wanted the original box. the listing states, at the top, that they come as new in the original box, at the bottom of the listing it says they like to recycle the boxes. Obviously I only saw the first bit.

Do I have to actually receive the goods to return them? I don't really want to have to fork out the extra charges just to send the item back, I know I wont get those extra charges back. Will I loose my buyer rights if i refuse delivery of them altogether before paying VAT etc..?
 
If the listing says they come in the original box and then they don't, then the item isn't as described. Can you not simply refuse to accept the delivery on those grounds?
 
I read somewhere that if you refuse the item you loose your rights, so if the item should get 'lost' then it will be down to me. If an item is refused i dont think it goes back the seller tracked.
 
Smells like buyers remorse?

Why would you really need the original box anyway? Providing you're satisfied that the goods are authentic then what's the problem? /devils advocate
