Hi guys, my girlfriend is getting a bit of grief on ebay i just want to make sure she is doing the right thing.

She bought a top which was stated as machine washable, she diddnt like the top so coppied the description and sold it on. Good feedback was left when she re-sold it.

Now she is getting mails saying its hand wash on the lable but she listed it as machine wash. She wants a full refund under item not as described.

Shes offered a full refund, but now the buyer is DEMANDING we refund the p&p as well. Do we HAVE to refund p&p for her to send it back?

All i can find on ebay is this.

In an Item Significantly Not as Described dispute, the seller can respond
The seller can offer you a full or partial refund

Where do we stand? Thanks.

if the goods are not as described, she's entitled to her money back.

Similarly when she gets the top back from the buyer, she can ask for her money back from the original sale.

I would think as you displayed the item as machine washable you should refund the money, after you get the item back. As for P&P, well, personaly if it was me, i would refund it as a sign of good faith and a way of saying oops, sorry.

Again though, depending how much the top was, lets say £3-5 plus £2 P&P i might think she has tried it on, not liked it, and found any excuse to send it back. Check her feedback and see what it says, has she done this before to anyone else.

End of the day, you did sell a top, with a slight mislabled discription on the product, but its hardly a life threating one is it. But, being a nice guy, id give her the full amount back, after i get the top back from her..

She bought a combined top with a belt, the top cost £6 and £2.50 postage.

She says this.

I would expect £6 for the top itself, the P&P paid to recieve the item (anything between £1.25 and £2.50 due to combined postage) and the actual cost of recorded delivery to ensure it's safe return to you (approx £2.00). If you can agree to all of the above then I will return item. (Probably would have been cheaper & less time consuming for you if you had opted to simply refund the cost of the top alone with no return). These terms are acceptable to me and the most fair

What the hell, surely she is demanding back more than she actually paid for it

We are saying we will fully refund the £6, but i dont think she is entitled to demand all these postage fee's as well

So she wants you to refund the cost of the top, and let her keep it?

Right....

I know

What should we do? Can we just tell her if she wants to send it back she will be refunded £6 ? and leave it as that. Or could she complain to ebay about us not refunding p&p?

The only reason i dont want her to refund postage is because her emails are so cocky and demanding

I think you'll be very lucky to escape negative feedback as she sounds a bit of a tit. Just refund the £6 and tell her to deal with it and accept the negative feedback as a lesson in writing accurate descriptions :)

If you have clearly stated that P&P will not be refundable in your return policy on your original listing then she cannot claim the P&P from you. Sorry can't be anymore helpful, sounds like a tough situation I hope it works out for you.

She has already left good feedback, unless she can change it i dont know

Oh, well in that case you shouldn't have to refund it at all. She should have checked it before leaving good feedback.

She wants the £6 for the item, plus £2.50 to ship it to her house, plus she wants the postage fee to send it back to you, another £2.50 I guess.

= £11

And she is right, you made the error, you should refund all costs.

I really dont understand how she can just make money like that. If she was being nice about it i personally wouldnt have had a problem refunding p&p as well.

But she was cocky and demanding.

Anyway i cant find on ebay site stating i have to refund p&p?

Do what she says, and get it back with the cheapest postage you possibly can. But only refund when you get it back. That'll make sure she doesn't try it on and claim it's been lost in the post.

Surely you're in quite a strong position now she's left positive? :)

From past experience I have usually found that the buyer usually covers the cost of returning the item... so you shouldn't have to cover her costs for this.

Did she pay by PayPal? If so, you should just refund this transaction if/when she sends the top back - even if she were to take this matter through eBay/PayPal, all they will force you to do is refund this amount after confirming that she has sent the top back :)

The right thing to do is give her the £11 back, but if she has already left you feedback then I dont think she can do anything about it and then its her own fault for not checking before hand so both partys have messed up.

She's in the right ethically at least as far as I'm concerned - her not being happy with the item is entirely your mistake. She should not have to pay anything because of that. Therefore the postage both ways should be your responsibility. Any online retailer, for instance, will (or at least should - most do) cover the cost of return postage if you return something that's incorrect or faulty. Why not pay her postage? It's your mistake, so your responsibility. When making a listing you are responsible for its contents, and responsible for any costs caused by a mistake.

If I were the buyer I'd do exactly the same as this person has, and give you negative feedback (quite fairly) unless you actually cover the costs that you ought to.

What did her positive feedback say? :)

Well, shes told me wrong, or i read what she said wrong. The item was bought as combined with a belt. She left good feedback for the belt but not the top she wants refunds on :(

Id have just refunded what she paid me (£8:50).No online stores including ocuk have refunded what its cost me to return fault cpus

iirc we had the same issue with an item on ebay and the seller doesnt have to refund the postage or pay for you to send it back was the response i got from ebay but go on their forums at ebay and see what they say.

Thanks mate just what i was after :) I just wanted to know my right.

Any other person id refund, but im telling her not to because of her demanding cocky attitude
