Ebay scam? Where do i go from here

My girlfriend isn't the smartest when it comes to tech, she bought me a nintendo switch from ebay (pre order pokemon lets go one) and it never came so, £350 gone. The seller says he doesn't believe it hasn't turned up but hes just having us on. It never got posted IMO.

Where do we go from here? It was a pre order so didn't even chase it for after 30 days as the product didn't come out for 4 weeks anyway it was on pre order and thats where i think she got scammed as ebay don't do refunds after 30 days?

It seems like a scam, no refunds after 30 days post up a product that doesn't come out for 30 days.

Do i go to small claims court or ring ebay up? she says ebay and paypal won't do anything because its been more than 30 days,

we have proof of messages, there was no tracking info at any point obviously she was expecting this when it got realised.

Lets go edition switch.

I have the guys address and If there's nothing else i can do i will be going down with "the boys".

This was a present for me so i feel bad, she has also bought 2 as when there was no tracking information sent she kinda guessed she got scammed but didn't;'t want to tell me to spoil to surprise.


So I'm getting all her ebay and paypal information to sort this out, I don't think she paid paypal i think it would have been direct card payment, we have tons of proof but the question is...

after i have all the information do I ring ebay or google small claims court and go to the first website i see to open a case or is there a number i call?

You can raise a PayPal case up to 180 days after purchase, raise a case with them. Not sure why they're telling you otherwise.
If she paid through eBay then it would have been using Paypal even if she used her card rather than an account IIRC so their cover should still apply.
 
I'm pretty sure you're going to get your money back. Cases can be opened for approx 6 months, and the golden rule tends to be, "no proof of delivery, refund issued".
 
Same, raise a case with PayPal, they say themselves they side with the buyer! Every time I’ve came across this on eBay I have always raised a case and they usually give you a date for a decision and I’ve got my money back every time! PayPal has a 180-190 day limit If I remember correctly.

Shame there’s so much folks on eBay to scam people!
 
You can raise a case through Paypal or you can talk to Ebay, they once waived their 30 day rule after looking at messages which proved my wife was being strung along by the seller.
 
Did you she pay by Credit Card? If so you also have protection there if PayPal / eBay mess you around.

This. Even if you were going to "go round with the boys", the last thing you'd want to do is broadcast that fact on a public forum as evidence in case he's not forthcoming with the funds and needs some persuasion

Regardless, you should have no problems getting your money back via ebay/PayPal, as if there's no tracking info then there's no proof he sent you it
