etailer seems to be messing me about - need some help

hello everyone

basically - i ordered a guitar from a website - there site said they had the guitar in stock, then, 4 days after the order, they email me saying :

Hi there,

Thanks for placing your order with ********. Your order is ready to be despatched, however we have just run out of the Fender Squier Affinity Telecaster you have ordered.

We are expecting more of these to be with us in 1-2 weeks.

As soon as we receive these your order will be despatched immediately.

We will send you an email when your order is despatched from our premises, so you know to expect it the next day.

anyway - its now been 2 weeks since that email and nothing - ok fair enough - but, i was under the impression that internet companys wernt allowed to take any money from your bank account until they actually send the goods/you recieve them? - only reseve funds - the money went from my account long ago - so im have no money and no sign of a guitar - anyone got any advice?
 
I'd email them and politely enquire as to what's going on. Inform them that the money they are holding has not been met with the delivery of the ordered in good time, and you are seeking legal advice as to your next steps.

i have sent them 3 emails - the last wednesday night saying basicallly i want to cancel my order - still nothing

btw - they arnt arnt reserving funds from my bank account - they have actually taken them
 
Have they got a phone number?

To be honest the next step is legal advice, if you payed via credit card, get in touch with your bank and ask them what they think. In fact, do it even if you're using VISA.

visa electron debit card :(

the thing is they do occasionaly respond to emails

i do think they have a phone number so i may ring them and work out whats going on
 
Debit card? That was a big mistake. Always use credit cards online if you have one.

You can still cancel now, and obviously be well within the 7 working days distance selling regs etc...

trading standards is the way to go if VISA don't help.
 
I pay for online fraud protection on my debit card so maybe check if you do?

well i dont have a credit card lol
erm - distance selling regulations allow for the item to be returned within a certain amount of time, i dont even have the item

its still within the time they said they would contact me so im not gonna be phoning a soliciter any time soon lol

i will check on the fraud protection thing but i dont think i do
 
You have the trading act on your side in this case. I suggest e-mailing them and politely ask what's going on.
 
First time I ever heard of an M3 CSL owner who didn't have a credit card, do you keep vast quantities of cash in a box under your bed? :p

Maybe giving a run through of what has happened to date, why you're not happy and what you want them to do to resolve it, e.g. delivery by xxxx date or refund.

And summing up with "I look forward to your prompt reply" or similar. Not nasty, but letting them know you're not going to settle for being given the run-around.
 
fox - your confusing me with the other guy - i dont have a csl - infact i dont even have a car lol


anyways thread update goes happily

i phoned them and apparently there email system is down, they canceled my order and the money is being refunded to my account :)
