Faulty item

I bought an Endura coat from Evans Cycles in Oct 2013. I wore the coat once when it was really wet. I went to wear it again about a month ago and the pocket has completely come unglued. I took the coat back to Evans who were going to get it repaired by Endura. Long story short, Endura don't have a warranty department to repair the item and Evans wont replace it without a receipt. I have no receipt and they wont except my credit card statement showing the purchase. Where do I stand legally about getting a replacement?

My credit card statement clearly shows the store, date and amount. Can I not claim through my credit card as the item wasn't fit for purpose?

Credit card statement IS proof of purchase. I'd push them more firmly, preferably by letter or a phone call to their head office. If you still get no joy then try trading standards/citizens advice.

Talk to the store again, if they won't budge, talk to higher-ups or customer service.

If no luck, look into doing a charge-back.

This ^

They are legally obliged to keep financial records for 5 years. You can provide the date, amount, store and payment method information which will correspond to their held records. That's all the proof you need - it would easily hold up as proof in a small claims court.

It's a faulty item, so doesn't rely on their T&Cs for returns (which may legitimately state you must have a receipt).

I originally started by emailing their CS with photos and a copy of my credit card statement. They were aware I had no receipt from the start. Their warranty department told me to take it to the store to check it which I did. I left the coat with them 10 days ago.

EDIT:

I just emailed their CS and they have found my receipt on their system :)

How do they know it's faulty ? As far as they are concerned, he is responsible for the damage. Also, without a receipt he has no real comeback.

Problem solved. :)

(resolved now, but to answer anyway...)

They know it's faulty because they can see where the manufacturing on the coat has failed - the pocket has unglued in the wet on a wet weather coat.

And, as pointed out above, you don't need a receipt - he quite literally does have a real comeback.

There is no damage to the coat. Looks like the glue / sealant. Its both sides of the zip.

Glad you've got it sorted. The person in the store clearly misunderstood the rules about proof of purchase. Their reaction to you showing the credit card statement should have been to print off a receipt copy for you.

Blah, issue, blah, first world problem, blah, resolved days ago, blah, bored.com, blah
