if he was to try and press charges, would eye witnesses do?
 
Judging by some of the replies in this thread some people need to get off their PC chairs once in a while and visit the real world :)

My dad was recently attacked in a similar fashion, the police said they couldn't do anything except tell the attacker to behave himself as it was his first offence. Same with the second offence, only third time can anything be done.

So basically you have free reign to assault someone you dont like apparently. :)

It would depend on the severity of the assault as to what happened but certainly for a Sec 39 assault ( Common Assault ) if the suspect makes an admission of what he did and has no criminal record then he would be eligible for a caution as the police are able to decide on that. This applies to adults.

Juveniles go by the reprimand and final warning system. A third offence would warrant a charge on the assumption that the injury was fairly minor.

For ABH and above, advice would have to be sought from the CPS.

Technically yes but a threat of unlawful violence against another is usually better dealt with criminally under Section 4 of the Public Order Act.

Is this by word of mouth only ? Some bar managers are notoriously canny for shenannigans with CCTV such as it wasn't on, it was pointing the wrong way etc. I would personally want to know that for sure.

It depends on what evidence they can give ? Do any witnessess know who did it ? Can they name him ? Describe him ? Know anyone he was with and so on.

It may be a case of VIPER ID issues at a later date and would they be able to pick him out ? Would your mate also ?
 
So four of this guy's friends stood and watched while he was laid out by one random scum bag and decided you'd go home and come back the next day to discuss it with the guy who runs the pub next door ?

Oh and he doesn't look funny because he's Canadian, he look funny because he's just been hit in the eye while his four friends stood and watched and he's beginning to realise what great friends you are.

Now that's confusing!

No mention of the bouncers doing anything in the 1st post and I wasn't advocating you beating the **** out of anyone, so lets use the simple analogy of person one picking up the Canadian (i've got nothing else to call him at this stage), person two calls 999, and person three and four keep track of where the one hit wonder goes from a safe distance.

As for the police not doing anything they would, the CPS may not do anything afterwards but that's not up to the police.

Sorry, confused. He's just been assaulted for no reason. Why wouldn't he phone the police straight away and instead go back the next day to the pub next door?

As that would be wrong, this is the correct way, OcUK Thread first, then the police etc.... :p

i had gone home with my gf (hadn't explained in first post), so there was one other guy there (his house mate) and a girl, the ***** was part of a big gang of boys
