True, but consider how many people you actually hear of getting convicted of such crimes, compared to the number committing them.
Then you have to consider how seriously the company concerned would take it. Victims of hacking/virii/warez are far more likely to want to pursue the criminals since they are actually suffering quite severely from it. Can you really see a games development house wanting to waste time and money going after some teenager who was wallhacking on GenericFPS2.5? I don't think so.
