First crash!

hmm I just re-read what you have written, originally I thought the biker was overtaking you from behind, are you saying the biker was coming towards you? if so you couldn't really hope for a straighter road for visibility, not sure how you will fare if that is the case

He would have been pulling some sort of crazy manoeuvre to do a right turn for the biker to have approached him from the front and then slammed into the drivers side of the car :p

That's what I thought, but then why would the beemer rag it past knowing full well he might get a car in his side?

precisely my point, I personally think the whole story is missing here, I might be wrong and it's very clear cut

however, one thing that road does not have is dual lanes, hence my initial interest

OP said the passenger door has a dent in it, or am I having a senior moment? :(

ahh I stand corrected, ignore my musings, stupid biker filter failings!

however it's still not dual carriage way - on that point I'm remaining stubborn ;)

The biker was coming up behind me (as was the beemer).

Rear passenger door on driver's side =P (In case you missed the other 3 replies ;))

unless the road has been rebuilt it is not two lanes of traffic, oncoming or otherwise

for clarity a while back I installed a load of fibre cabling behind admiral rentals so I know the road reasonably well

It's not marked as 2 lanes, however this image from streetview shows that there is plenty of space for 2 lanes of traffic - which at the time there was - preparing for the junction slightly further up (where it is marked as 2 lanes)

That makes sense... well other than inside and outside arguably being the otherway round?

Hehe, possibly - there was a car in the "lane" nearest the pavement - as I said, the road isn't marked as such, but there is more than enough space for 3 cars parallel and the BMW obviously took this opportunity - possibly gambling on the fact I wasn't going to move due to the car in the far lane?

given everything you have said I have decided you were not at fault and the biker was being a tool..

lets hope everyone else agrees with me :p

Agreed. insurance should be fairly cut and dried on this one, no ones fault but the bikers. you can reasonably be expected to watch for overtaking bikers when turning right from stationary with your indicator on. Biker fail and the BMW driver gets a 'grade A ****' award too.

I don't understand how a BMW and a bike had the time to overtake you. If you were waiting to turn into the industrial estate... surely you were waiting because there was traffic coming towards you in the opposite lane.

Now if the driver had time to pass you and then cut in front and back onto his lane.... surely you had time to cut across the road and turn into the estate?

Here's a mockup.

If the red line is oncoming traffic. How could the biker possibly think he could have gotten past?

You say the road is wide enough for three lanes? It's still quite clearly a two lane road. So I'm confused.

I've either totally missed the point or... erm... something else :S.

Can anyone explain please?

Indicator not working - no way two people would go past otherwise, not at that location.

If you want, I can go and take a picture of the 2 lanes of traffic later tonight (if my insurance can actually be bothered to get a hire car out to me after chasing them for 4 days)

Correct.

It's still quite clearly a two lane road.

Also correct.

So I'm confused.

The road is marked as 2 lanes.

however

Oncoming traffic was using it as 3 lanes in preparation for the junction ahead. You can clearly see from the picture you've posted that it's a very wide road, easily enough space for 3 cars side by side (possibly even 4).

Also your picture is inaccurate, my focus is (was) silver and 5 door :p

Let me just clear it up. It's not your fault, it's theirs.
(Loving the MS Paint jobs btw:D)
