The flatmate is being threatening, rude and unbearable to live with.
If the other person, tom, moves out they have to pay the full rent untill another flatmate is found to replace them. Threatening flatmate will take as long as possible to find someone else so tom will have to pay full rent even after they have moved out for quite some time. The landlord has said that threatening house mate must be happy with the new tenant. Threatening housemate won't agree to any of tom's suggestions.

any ideas?

Erm knock **** out of him, move out though really. No point staying with some one you can't stand.

You at uni or full time work?

Full time work. If Tom moves out he'll have to pay for the rent of this current flat and the new flat which he can't afford. I'm quite annoyed as there's no solution i can think of.

as much as i would like to hit him i know he'd go straight to the police.

Gang up on him and stop being a pussycat?

There's two of you FFS - whatever he's doing, be nasty back. Play jokes, snigger, take the ****, rip him. "Tom" shouldn't move anywhere as he'll be shafted for rent as you say.

Anyway what's the whole story? Why is this person being this way? Any reason whatsoever? Tom didn't take liberties with his mum or anything?

get a trusted mate to give you a black eye, then call the police and report that you are suffering domestic abuse from your "partner" (flatmate) but can't get away because of the rent contract, and that he doesn't want people to know he's gay so denies that you are seeing each other to everyone :)

Check your contract, if you each signed a tennacy agreement you will have to do that, however if you signed a group contract why don't you and tom move out then the full rent will be left to other housemate and dont give him a point of call for where you moved to.

KaHn

how about you force the aggressive one out, complain to the landlord and make the aggressive ones live hell, until he leaves or shuts up.

I don't live there. Whenever i am there he won't do a thing.

The guy is nuts and Tom is a weakling. He's trying to get tom to hit him just so he can report him to make tom's life worse.

Be there when he does it, then report that the violent one attacked tom.

Get your mate to move somewhere else ?

That's the whole problem here... he can't, because whenever he suggests a suitable person to take over his tenancy. the 'threatening' housemate doesn't agree to that person. So he can't move out until someone suitable takes his tenany otherwise he has to to pay two tenancies.

first port of call is to tell the landlord and discscuss it with him, have you tried this yet?
It might also be worth phoning up cab and seeing if they can suggest any course of actions to terminate the contract or to help persuade the landlord.

Just move out aswell give him no detials of where your moving to and let him deal with the crap.

I personally would kick his head in but that isn't always the answer.

how long is left on toms tennancy?

get tom to start looking elsewhere so when the agreement is up he just goes (also try to keep it secret enough so that when violent man comes home one day he discovers hes living on his own)

then give it a month and go back ninja'd up and give it to him kb warrior style :p

I doubt whether the landlord will do anything tbh. The CAB suggestion is definitely worth following up.

Threatening flatmate will take as long as possible to find someone else
why cant Tom just find someone straight away himself?

The landlord has said that threatening house mate must be happy with the new tenant
Who cares what the landlord said? Does it state in your contract that everyone must be happy with a new tenant LOL? Never heard of this...

well in general when a guy says he wants the place, and the guy doesn't want him to be nice tennant, when he comes round he'll say so. its rare that someone will want to move into a flat with an openly hostile pratt, its all well and good to show the place and in theory get an agreement, but after that meeting the other flatmate, it will be a no go.

contracts really have to have clauses for these things, even if it gives leeway for manipulation by some people. contracts simply shouldn't lock people into an bad situation.
