One of my customers uses a domain for all of their email, they do not have a website but would like one.

They were paying £200 pa to renew the domain through some shady bloke who registered the domain in his own name and details.

They are now unable to get hold of the bloke and would ideally like the domain to be registered in their name.

What is the process for applying for this to happen? Is this even possible?
 
Difficult and even more so if the domain is not actually registered in your customers name.
You can't for example simply make contact with the domain registry and ask them to change the registration details over.
That would be akin to me picking a domain name I rather like the fancy of and asking the same.

When you run a WHOIS on the domain is the e-mail address under "Administrative Contact" an address you have access to?
If so, get yourself a free account at say www.123-reg.co.uk or one of the other companies people will recommend.
Now start a domain transfer.
If the domain is a .com or .net then the administrative contact should be sent an e-mail asking if you approve of the transfer.
All you need do is follow the URL, paste in the code and the transfer will take place.
You can then change the contact details.
It's more awkward with a .org as they require a code pre-transfer these days.
A .uk domain is awkward again - these are push rather than pull domains.

Ultimately the easiest solution is to get in touch with the guy who is currently holding your domains, however as he is charging you silly money he maybe reluctant to let this happen.
Basically speaking your domains are being held to ransom and there isn't a great deal you can do about it - mainly because they aren't registered in your own or your customers name nor do you have access to a control panel so you can manually make changes to the contact and/or e-mail addresses associated with the domain.

The main problem is this Dale chap has left the company my customer used to use for IT support and nobody can get hold of him.

That sounds to me like your domain is a .co.uk domain.

I would phone Nominet up - I've spoken to them before and they are very helpful. Contact details here. http://www.nominet.org.uk/about/contact

Worst case is you can fill in a domain dispute form which costs around £20. Nominet will then contact Dale using his last known details. If he doesn't respond and you are able to provide proof you have been using this domain for the last few years (email printouts will suffice) they will release it to you.
