This is actually doing them out of money (they'd have to pay commission to the developers of anything you buy with the points) so IMO it would seem worse from their point of view.

Yeah It was lies to scare people. Ofcourse Microsoft can take them back but they wont. Fox will have bought them from Microsoft and its their own fault for not making their site properly. It should have checked gamertags and it didn't.

They cant complain to Microsoft and get them to pull the points back because Microsoft will just turn to them and say its their own fault - which it is.

damnit, want to buy worms, for free would have been good. I hope this makes a comeback.

As for the loading circle, that would seem to me to have nothing to do with this, rather it is just the shoddy xbox live experience we seem to have to live with these days.
