Friend has got done for speeding :(

Hi all,

Need some help / advice please

My friend has just got done for speeding.

He got clocked at 64mph in a 30mph zone.

What do think the punishment will be?
 
You(r friend) will get 6 points and a fat fine, plus the possibility of up to a month and a bit ban.

That's the standard, but you(r friend) is very high, so it could be more serious.

Suprised that DD wasn't put on the thing either, that's a big margin in presumably residential area.
 
I know the speed seems excessive - But this road is practically a dual carrigeway and there are no clear signs showing 30mph.

This was 07:30 on a Saturday morning - The road was totally clear.

Doesnt it need a central resivation to be a dual carrigeway?
 
To be fair its a silly speed and he should rightfully be banned, however there are roads round here that are 30s that have no houses and are dual lanes and so at most times high speeds are pretty safe. A stupid thing to do but still, not always how it first appears
 
assuming he only gets prosecuted for speeding.

either

1) a 14 - 56 day ban ( cannot be more than 56 days purely for speeding )

or

2) 6 or more points if he can proove that he needs his license for work - ideally a written statement from his boss to produce in court that he will be sacked without his licensse.

Theres no hard and fast rule, as 25mpph over the limit or above you CAN be referred to the magistrate but its not guaranteed. Think its pretty certain for doing 65 in a 30. You can be referred for doing 50 in a 30 (ie 20 over the limit) which is the one speed limit there is an exception to.

as for ban or points ? thats up to him if he can proove he needs his license, otherwise most likely a 28 day ban.

I was caught doing 107 on the M1 and get 28 day (or more) and £70 fine. Any qs just shout.
Magistrates should take account of the time of day, the day and traffic conditions when considering how dangerous the offence was.

If this is true, then you can argue that there are no speed limit signings - however, I expect there are. What road was it on?

It may be a defense but in my eyes its not really an excuse - if he didnt see the signs he should have been paying more attention
