got parking charge last night

down at my gym they have just put new disabled bays and i parked in one of them last night without noticing. it wasnt yellow marked just had the wheel chair marked out in white but i didnt notice due to habit.

my fault so i except my punishment, £60 though :(
 
Ouch £60 stings a little.

Im glad someone somewhere is punishing people who park in disabled spaces though. (Not an attack on you, as you seem to have made a genuine mistake) but I hate it when I see people pull up and park in those spaces for no reason at all.
 
no i totally agree. totally my fault so deserve it. ill double check next time every space i go into even if it is a usual routine space.
 
I know you have already accepted the fine and taken it on the chin, but I'd check the legality of it.

I always thought disabled spaces had to be painted in yellow? I wouldn't park in one if it wasn't, but they're suppose to be easy to see so people don't make a mistake.

I'm probably talking rubbish but it rings a bell from a programme that was on about parking tickets.

im going to double check the disabled bay tomorrow when im at the gym again. ill report back. i havent sent the cheque off yet, i will do tomorrow

Seems it has to be yellow.
 
Refuse to pay the fine. £60 is extortionate for a genuine error.

This is what I hate about society today - there is no common sense. For example, getting a parking ticket at 4:59pm when the cut off time is 5pm (ie free parking after 5). Furthermore if you are paying a gym membership then you have a right to use the facilities and they should provide customers with sufficient parking spaces.

Be sure to get photos of the bay because they might try to sneakily add the yellow lines tomorrow.

Because, quite simply, they can.

A necessary evil imo, if laws & rules are not kept to specific units, then people will abuse the legal ambiguity.

I do agree that discretion should be used in individual cases though, such as parking.
 
I'd explain you were giving a disabled mate a lift to the gym....... ;)


I'm still awaiting any further action on the ticket I got for my "Mercedes 728i" :D

Civil Parking Wardens should be fed to Crocodiles imo. :mad:
 
Seems harsh tbh, If its a new bay then they could have just left a warning to lets peeps know for the first week or two and kept a note of your reg, that way you get advised of the change but if your a numpty and keep parking after being warned then they could issue a ticket.

As to the bay having to be yellow, is there a difference if its private land? many car parks are I beleive? Just a thought.

read the pepipoo forums, they really have little (no) chance of enforcing this, they will send loads of theratening letters but afaik they have no legal basis on which to enforce it

I dont know whether it makes a difference to whether it's yellow, but it means legally it cant be enforced, on private land disabled bays mean little to nothing unless the owner says so (and makes it explicitly clear to anyone parking there), i'd take it up with the gym first and ensure they're aware it's happening (presuming it's the gym carpark) also check for warning signs
 
Yes this is total BS - they have no authority to demand you pay £60, especially since it was a new bay. The law will side with you on this - extortionate parking charges are not usually double legal and they would never take it to court. Even if they did take it to court the judge would only ever be able to make you pay £60 - £3 a day??? That is 1925% AER! Hardly a fair rate for an unpaid debt and very illegal.
 
A court couldn't even force the £60, the only chance they have is to prosecute for trespass and then they can only claim for the real losses that this trespass caused

I'd ignore it, so are the only bays you can get fined for parking in the yellow ones? Loads of places I've been to have blue and white ones so does that mean I can park in them? :D (I would never actually do this)
