I have a suspicion re-warranty ... that it would be the same as anything you sell on to someone else as "second hand".
IE. the original owner would need to pursue any warranty claim. That's how I've always understood it. Hence why people selling on the MM (me included) pretty much always say something like "in case of a warranty issue, I'll help out etc.".
To quote from What Consumer:
"Firstly, remember that the statutory entitlement of quality and fitness for purpose only applies when buying from someone who is ‘acting in the course of a business’ i.e a second-hand car dealer. You do not have any legal recourse as regards quality where you are buying through an individual who is selling an item as a one-off private sale (although they must have legal title and it must be as described in the advert)."
Though there might be someone else that can shed more light on this.
