Gym Contracts - OFT Deems then unfair

hopefully this will set precedent that will spread over to the Mobile-Phone world :D

Mobile phone contracts have a liability to pay from the beginning, so this ruling doesn't really apply to them.

Emphasis mine. This is the key point, and what differentiates gym contracts from other types of contract. Mobile phone users and lease car users very rarely just stop using the agreed service, and certainly not en masse.

Loads of contracts are like that, xbox live, lovefilm etc. Used for a few months and then never again, so credit must be a part of it.

Does xbox live or love film have a minimum term substantially greater than the average usage?

This is just Ashbourne though right? Thread title is misleading unless this refers to all gym contracts?

Indeed it is, although it would also set a precedent to other companies with similar issues. It would not, however, apply to a gym company with an contract length of 12 months and an significant percentage of members using it for at least 10 months...

It's certainly food for thought, if its good for the goose its good for the gander.

Reading between the lines, the judgement was correct, a lot of gyms seem to go down the legal/bad credit route when people stop going after 3 weeks of a 12 month contract, they know this, and they actively profiteer from it, its almost like it's part if the business model. ;)
 
I'm moving 20 miles away from any dw fitness gym and im 3 months into my 6 month 'contract'.unknown to myself, my direct debit hadnt been working (i dont really monitor bank account) and then i get an angry letter from them. Ive emailed this link to them and also told them they broke their own rules. As they sent a letter saying basically 'pay your arrears ( we havent told you your direct debit hasnt worked for 3 months), pay or talk to us within 10 days and we wont pass you to debt collectors. 5 phone calls the next dayand 3 emails in the same day, 5 days pass and i get abuse from ARC credit agency... So speaking with area manager on monday. Hopefully this ruling can get me out of having to pay for 3 montha worth of nothing
