Shaking like a leaf atm as in 15 - 30 mins i ll be handing in my notice as i have a new job lined up, any advice on how to calm down or even how i should start the conversation?

help me.....

Don't worry about it, employers have people come and go all the time. Ask to speak to your manager then just explain it's time to move on and give him your notice.

yes my letter is written out,

@phi1 - it isnt a big workplace so i have no manager, just the owner and his sister, im not leaving on bad terms and i beleive i have taken their bike shop business as far as i can with the resources availble hence the move on....

this is why its harder i think as its a fmaily business so no on ehas left for years...

Well hand it to the owner, I am sure they will understand. People always need to move on in there life.

just spoke to him and he told me to keep my letter untill he checks my contract to see if im on a weeks notice or more as my letter says 1 week.

im paid weekly so does that mean it is 1 weeks notice or is it dependant on your contract?

I'd think it's dependant on your contract. To be honest if you have been there for years 1 week seems a little short. Have you known about this for a while? It doesn't really give him much chance to get someone else in.

whilst i appreciate that i have a start date alrdy for my new job so if im on a weeks notice then thats all i ll be doing. i need to be thinking more about my own life than the works...

Tbh you should have checked your leaving notice before hand. 1 week is short. Just try not to disrespect them as you might need a job one day.

i couldnt find my original contract but ppl i have spoken to have all said that weekly pay + 1 weeks lying time = 1 weeks notice so this is what i took as correct.

dont go on what people say, go on whats in your contract.

your payment terms do not equal your notice period

if it says one month notice, then you should give one months notice (or whatever it says)

not right to drop him in it with only a week to try to replace you, if you were him wouldnt you appreciate some time to find someone else?

one week is hardly long enough to find someone, interview them and get them to start

im not dropping him in it, im giving him what i believed was the correct amount, it turn out im 4 weeks notice so this is what i ll be doing. I had no intentions of dropping him in it but at the end of the day, you work for yourself and your family, not to line the pockets of the owners.

EDIT - i just recieved a copy of my contract and there is no mention of notice period so how do i progress forward now?

its got nothing to do with "working for yourself, not the pocket of the owners"

its got to do with respect and doing the right thing

and how you would feel if someone did that to you.

one day you might own a business and then you would think differently

edit:

i suppose it would also depend on how long you been there, and if he they were good to you during that time

If there is no mention of a notice period,

"The minimum statutory notice period which must be given by an employee is at least one week's notice if employed continuously for one month or more by that employer. This minimum is unaffected by longer service.

Notice you must give your employer

If you have worked for your employer for one month or more, the legal minimum amount of notice you must give is one week.

Normally your employment contract will set out a longer notice period. If it does, you should give this length of notice to your employer.

If your employment contract does not set out a notice period you should give a reasonable period of notice to your employer. This is included in your employment contract as what is known as an ‘implied term’. What is 'reasonable' will depend on your seniority and how long you have worked there.

If there is no set period in your contract then try to be reasonable and offer two weeks notice to him. But make sure you double check the contract.

of course i agree there is respect etc but at the end of the day if you get offered a job that starts in a week, and your on 1 weeks notice, your telling me you would turn it down out of respect?

sometimes difficult choices need to made...
