pretty much or else the company could be accused of slander or done for liable or something along those lines

Hmmm... I'm don't agree.

For my recent job acquistion one of my referees wrote a praising reference letter to the company, only to receive a phone call a week later to say that they weren't allowed to write that and that they'd be sending a reference form for him to fill in. It simply asked if I worked there, the duration of my work and my job title.

My current employer has a standard reference also, it's too easy to get into trouble writing the wrong thing. They aren't allowed to praise people as this may show favouritism and not be a sign of a good employee.

I managed to get the job, so it can't have been seen as a bad reference. Furthermore, they didn't get the references until I'd signed the contract for my new job so a bad reference wouldn't have made a difference.
 
Most firms will now only state how long you for the company, give your job position and the dates you worked there for. Anything else they can be sued for weather its praise or a bad reference.

Well only if I backed it up with proof!

I wouldn't just say that, I would have physical evidence (timesheets etc) to show that they were not good timekeepers!

Exactly. If they say you're a good timekeeper and you turn out not to be for your new job, there's a (albeit very small) chance they could sue the previous employer for giving bad advice.
 
iirc if they praise you to a point of being better than you are and the new company losses money / value because of your glowing incorrect reference then they can also bring a legal case against the referee
