Harsh or not...possible custodian sentance?

People on bikes in London are terrible, they always go through red lights all the time and its not on. There should be a big fine for this like there is for car drivers. In this situation both are to blame but 4 years sounds a little harsh.

LOL at you all having a go at the cyclist.... he's dead! how much more punishment do you want him to get???

As has been stated, she was on her mobile, ILLEGAL, she killed a guy and was convicted based on evidence which the news does not give!! but it must have been substantial?

thought it was the law, the same as its the law to exercise the proper indication techniques, have reflective gear at night? I feel quite sorry for this lass, obviously she shouldnt have been texting etc but the guy went through a sodding red light.. its not like it was with intent or anything.

We aint really punishing are we? He broke the law, if he hadnt gone through the red light she wouldnt have ran him over.. darwins theory anyone?

Yea obviously she deserves a conviction, but conviction doesnt always have to mean jail, especially not 4 bloody years.

I'm conflicted....

1) Serves the cyclist right - I hate 'em and hate them even more when they go through red lights.

2) I hate people who text or use their phone whilst driving.

they were both guilty and wrong. It's a shame that someone died so it does disagree a little with my 1st comment, however if he had survived I'd have given him a kicking.

As for the woman she deserves everything she gets. There is NO excuse for texting or using the phone whilst driving.

and had no helmet, which is stupid.
Cycling helmets are not the be all and end all of cycle safety - indeed they can cause more harm then they protect.

Regardless, cyclists going through red lights happens all too often, and in most cases I'd have no sympathy here. But being on a mobile whilst driving is stupid, so I don't feel sorry for her.

The problem lies with whether the woman driving could have avoided the cyclist had she not have been using her phone.

Obviously so much more to this than your post and I havn't time to read up on it.

The debate last time was that there seemed to be no proof she was using the phone at the time of the accident, but it would be good once in a while to have all the facts from the press.

some people are just decent at multitasking, Iv got friends who hold there phone up so they can see through the windscreen at the same time, they lose concentration more when they see something on the side of the road .. something funny, an advert, a tart etc..
Obviously its illegal and shouldnt be happening but when you have the green light you generally are not really going to be very alert, as only a complete idiot would go through a red..

It doesn't matter whether she was texting at the time of the accident or not. They would know her journey and approximate time it would take. You can have an accident 30 minutes after you have texted or used your phone along your journey and they will have you for it.

4 years is a long sentence for that sort of crime, much longer than i've seen for death by dangerous driving in my area.

They must be having a real clampdown. Yet we all see people driving and texting/calling everyday.

A tough call. Sure the death wasn't entirely her fault but she shouldn't have been using a phone, period. If she hadn't the cyclist, whilst still at error, might have lived.

If she wasn't using the phone she wouldn't have been charged at all. The sentance does seem harsh still. However, is 4 years the minimum sentance?

if he hadnt went through a red light she wouldnt have been charged for it, just like millions get away with using theirs everyday, it seems as if she is being made an example of, its a ridiculous sentence.

Millions don't kill people every day because they're distracted behind the wheel by using their mobile phone.

So anyone caught speeding should be let off, because only a few of those actually have accidents??

According to the radio (Wave105), the driver was speeding at the time.

ah thats fair enough, still seems harsh.

4 years isnt long at all for taking someones life IMO

its fair enough and theres no way shell do the full 4 year either

she'll do 2, which is still too much imo. It was an accident, do you see doctors or nurses getting prison sentences when they make a mistake?

Millions dont get distracted by their mobiles you are right.. but millions get distracted by other things.. and cyclists dont ride infront of them through red lights =/

Im not arguing that she is innocent, im just thinking that she has received too heavy a jail term when she blatently will have the punishment of knowing she has taken someones life for the rest of hers, and shes taking up a prison bed, and costing tax payers money, wouldnt we all rather she put something back into the country? shes hardly a danger to society.
