Has this girl committed a crime?

My GF gets a call from a friend this morning in floods of tears and panicing becuase she thinks she in trouble with the law.

I think the story goes that she and her BF drove into town for a night out with the intention of leaving it overnight. He is banned for drink driving until the end of this year. She gave him the keys because she had no pockets.

Later they argued and made to go home. He wanted to drive (he has been driving during his ban) but she did not want to get in the car. He said walk and I'll drive home and she let him drive her car back to her house.

For reasons only known to himself, he took a wrong turn and decided to reverse down a one-way street - into the path of a police car.

So they lock him up and go round to the girls house to get her story. I think they've given completely different stories. The policewoman implied that if she let him drive her car and she was aware that he was drunk she would be in trouble as well. She was going to say that her took the car without her consent but decided he was in enough trouble as it is - although I wouldn't be surprised that if she has committed some sort of offence she might try to change her story and say he took the car without her knowledge :rolleyes:

Personally I couldn't give a monkeys for either of them but my question is, has she committed a crime? I'm sure if you let someone whose drunk drive your car and you are in the car too, you are in serious trouble however I'm not sure what the implications are if you are not in your car at the time.

Also, please keep replies to the question not the usual hung drawn and quartered rubbish of committing a crime in the first place. :)

your girlfriend has 2 boyfriends?


when it comes to the law its best just being honest
 
I think technically yes she has... but she can just say that he wouldnt give her the keys back and was being abusive and possibly violent ( because he was drunk) so she had no choice but to leave.

He is in deep doo-doo but im be VERY surprised if she got more than a slapped wrist... tell her to play the frightened female part with him as the drunken bully, no one would find her at fault.

TBH its HIS fault he drove not hers... hes the clown not her and he will pay for it, not her.
 
Lads, lads - I know its a Monday but........... :D

My girlfriends friend called this morning in tears (as in my girlfriends friend) because my girlfriends friend let her boyfriend (as in my girlfriends friend boyfriend) drive her car knowing he (my girlfriends friend boyfriend) was drunk and also banned.

Any better? see;)
 
As i see it she has 2 choices

1/ admit she gave permission, thus she is an accessory and it they can charge her with offences that are virtually equivalent to what he will be charged with

2/ say that she did not give permission in which case the driver will also be charged with taking a vehicle without the owners consent ( he is quite likely to get a prison sentence anyway so it may not make a huge difference )


I doubt she would get in trouble for changing her story , the poilice get it all the time

So if she admits she gave him permission, what sort of punishment would be expected?

I think she is going to say she didn't know he was drunk or that he was banned.

Causing or permitting to drive with alcohol level above limit.......... code DR12 - ban or 3-11 points

Causing or permtting driving whilst disqualified by order of court.......... code BA12 - 5 points

Causing or permitting use of a vehicle uninsured against third party risks..........code IN12 - 6-8 points



no idea how the "not knowing" bit would hold up

friendA = my frend who owned car
friendB = my friends friend who said he had insurance
in eyes of law ignorance is not acceptable, a friend of mine (friendA) got 6 points (and had to retake test) for letting another friend (friendB) drive his car with no insurance, friendB insisted he was insured to FriendA who was stupid enough to take his word. FriendB crashed FriendA's car into a third party and tunred out FriendB was not insured.
FriendA did not know FriendB was not insured and FriendB told him that he was, FriendB also stood up in court and said he lied to FriendA and missled him. FriendA still got 6 points and had to retake his test.

Never trust anyone who says he has insurance without checking with there insurance company yourself, You will get in trouble. If you own a car it is your responsibility that anyone who you let drive it is legal in all aspects.

Just got a call from my GF. Apparently, this girl has said to the police that she didn't know he was driving her car. According to her, the police aren't interested in taking the matter further with her and won't be looking to charge him with pinching the car.

This girl also said that police/judge will go lightly on him because he admitted that he was drunk and banned straight away.

What "Lightly" means I've no idea - He's driving whilst banned. I doubt he has insurance so is driving uninsured as well.

He's continued to drive during his ban anyway so further points and extended length of ban won't make much difference.
 
im not condoning drink driving in anyway...i think drink drivers are scum....

BUT

my uncle is one he got banned for drink driving, and then caught again drink driving whilst being banned for drink driving. he was very lucky he didnt get sent to prison, i think the only thing that kept him out was the fact that he had 4 kids and a wife who was virtually disabled after a car crash. he was banned for 5 years but only had to do 4 years of the ban, he also got a hefty fine and about 200 hours communinity service. prior to that he had a clean record criminal and driving licence bar 3 speeding points about 3 years prior.

as for the girl her punishment all depends on her story...if she continually changes her story she will loose all credibility and may open a whole new can of worms on herself
 
Drink driving while banned can go either way

extension of the ban along with a fine and community service

however drink driving while banned for drink driving I would imagine 3-6 months in prison to be more likely
 
Sticky situation, if he decides to be a man about it and tell the police that he forced her to let him drive the car he could probably get done for something along the lines of car theft, so it's doubtful that he'll admit to that.
