Help - work/sick related

Not a reply to the op as such but my company handbook actually states unauthorised abscence is a breach of contract?!
This is under sickness so I wonder how they could deal with that if the op ha similar, or is it just typical wording?

That's typical, referred to as AWOL or unnotified absence.

When the OP calls in sick, he's done his part in notifying them as long as he does it within the timeframe specified in his contract.

The employer CAN NOT refuse sick leave once notified. EVEN if they have reason to believe it may be fraudulent. That is dealt with via return to work interviews and any further required measures should company sickness policies be breached by the length of absence.

Basically, he can call in sick whenever he bloody well feels like it. No company is within rights to give the third degree or demand that people attend work when notified of sickness.

Wow they CANNOT do that... I can't stress that enough.. Boy they are heading towards trouble

Totally agree. Phone I say you're too sick to work and that if you were capable you'd come in. Then quote some stuff from here:

http://www.direct.gov.uk/en/Employment/Employees/Sicknessabsence/DG_185054

Note under the part about long term sickness it says the employer can dismiss you as a last resort only. They can't fire you for being sick or you could take legal action.

Feet up, hot cocoa and some Jeremy Kyle for you! ;)

I'd document any sort of threat they make as well. If you let them know this evening you wont be in, then ring again first thing in the morning and tell them you're still not up to it and record the conversation if you can.

Sod them.

Oh this takes me back! Pretty sure I was told that I must go in aswell. Probably did because I'm an idiot.

I hear it all the time from my mum who's a manager. She actually ended up going in to work on boxing day when she was supposed to be off because someone called in sick and the person she tried to get to cover let her down too.

did 7 and a half years in retail, tell em to take a running jump your ill and they cant threaten you for it. if they take offence get a sick note and take a week off.

does remind me of where i worked, seems its a culture of treating staff like crap and bullying them to fear being sick.

...very important to keep yourself covered and phone in everyday and tell them why you can't come in. If your sick your sick.
Sounds to me like no-one else can do your job and you are worrying about that. It's not your problem.

Aslong as you've been there more than a year not much they can do other than bitch and moan and threaten. If you've been there less than a year you have far less rights.

they think ur going on an all day bender for new years

jelous imo just dont go in or they will always walk all over you

Make sure you get a doctors note.

He does not need to unless he is off for more than 7 days. He can self certify, ie he goes back to work, they say "were you ill", he fills in a form and says "yes I was".

You are under no obligation to go to work if you are unwell. You will do a poor job and be a liability to the company - as you say, if it was a desk/admin job you might get away with it but not in a customer facing role.

Do not go to work but make sure you inform them daily/in line with your company policy so you don't end up in the mire over a technicality.

Do I go and hope I get sent home(unlikely)
Most employers will not (as far as I recall, should not) send home unwell employees. You as the individual have to decide if you are fit to work.

Don't let principles come into it - if you are not sufficiently well to attend work, you do not work. End of.

Do not go in, other than the obvious aspect of being sick therefore entitled not to be in work you sound like you problably have something contagious in which case its highly irresponsible to go anywhere in public or working environment. Giving your illness to 200 customers and your collegues who will then spread it further is exactly why we have outbreaks of norovirus and similar in the community because of idiots not staying in isolation when they should.

Makes me Laugh at Tesco when they want you in when you are literally dripping fluids everywhere.
Ere Boss isn't this a food outlet frequented by a bazillion of the publics.
Mmmmm We can't do without you.
BAZZINGA !!!

My girlfriend works in the labs at a hospital, if any of them so much as sneeze or cough have to have at least 48 hours off lol. WIN!

Cheers for all your help/input chaps, it's much appreciated!

I ended up not going. Like some have said, there's no way they have any right to walk all over staff. To hell with them.

I manage a business and can tell you this is not acceptable. No one has the right to demand you into work when you are I'll. If I found out one of my supervisors had done this a very serious conversion would be happening.
