House mate leaving before the contracts up !

Actually....thats a great idea, make sure you leave the new address/parents address of the guy who is legging it on a note on the table, and make yourselves scarce...thus making hm suddenly responsible for the whole rent :D
 
i was gunna point that out, theres 3 names on the contract, if 2 honour it then its surely up to the 3rd. Because the 2 who were being forced to pay for the 3rd could then threaten to move out, meaning they all had to pay anyway.

Sit him down, give him a slap, see what he says. Its his responsibility to pay up till a replacement housemate is found, they get his room and not yours. Make that clear.
Inform the landlord of the problem and make sure he knows you 2 are paying your share and the other guy can be rang and money requested off him, chances are the landlord wont want the hassle and will just say you're not getting your chunk of deposit back if it goes wrong to the guy - does he realise hes losing £250? Thats 5weeks rent in your place right?
Im fairly lucky, iv got my own agreement, with only my signature on it. Joint Tenancys seem shocking!
 
The tennancy agreement isn't a contract between the tennants, it's a contract between the Tennant(s) and Landlord.

I used to be a client accountant for a letting agency. I delt with this kind of thing on an almost daily basis.
You seem to know your stuff, if not how to spell tenant :p

Is there any kind of contract between tenants that can be drawn up?

Faith and trust are a little worrying when one considers most house shares are on a joint tenancy.
 
somebody i lived with tried to get out of paying his rent. he moved out but the landlord said that he would take him to court unless he paid the rent. it says in the contract that if one person leaves, it is up to the remaining tenants to pay the rent but the landlord told us that the remaining tenants are only responsible for this rent once they have been to court. he pays no bill but does pay the rent! still got another 6months of the contract left!
 
House mates don't you just love them !

So I share a 3 bedroom house, all 3 of the house mates signed a 6month contract in Oct 07 and on the 20th Dec one of my house mates decided to tell me he's moving out at the end of Jan !

Great ! as no-one has any money in Jan.

So I've tried and tried to get someone in, advertised at work via intranet via memos around work, Via everyone of any use to me in face book, via anyone in any use to in in my phone book.

Basically i've had some interest but everyone is saying the same thing, In a month or so thy'd be ready to move in !

Looks like not many people are stupid enough to get in this situation in Jan.

So if we've all signed a contract with our landloard can I and my other house mate make him pay his rent ? what rights have we got ?

I already know he's cancelled his DD for Feb, and as I pay the landlord the rent out of my account he'll be ok but i'm fubar'd really as i'll have to stump up the extra cash !

I've not yet confronted him and said i think he should pay me the rent + bills.

He's basically let us in the sticky stuff at a totally unreasonable time of year, and i'm not impressed about it at all.

Problem is we're suposed to be mates ! and I don't want to cause a massive rift, but the general feeling from most of my other mates is that they feel he should pay as he's signed a contract so tuff on him.

What can i do ? what rights do i have if any ?
Anyone have any experience of this type of situation ?

Any help will be appreciated.


Shame I don't know you , I 'm looking for a place to rent. I'm in york also. :p
