How does this happen...

Never understood people who sit in the overtaking/3rd/4th lane..

Your just that little bit closer to the otherside of the motorway and a nice gift of jacknifed lorry or some such.

Yep thats what I do especially if the other person is in the third lane and im in the first with no cars about...Less hassle for everyone than flashing light / indicating to get them out the way. Just leads to the n00bs getting stressed out and probably crashing or something. I just rocket past them on the left! No problems...

I usually hate those people that flash me from behind to get me out the way (espeially when I already doing 80 - 90 mph) but for the first time when it was abit busier, I was coming upto someone doing about 65 in the third lane so I did the old flash flash thing. They moved over and ive gotta say when they moved out the way in an odd way I felt pretty awesome! Like an officer of the law must feel blasting through traffic! :cool:
 
An alternate method is to sit on the offside and indicate on the offside . I believe this is used in Germany. I find just sitting in the offside position will usually make people ware and move over.

I must admit however, that if it's really clear, and I'm in the inside lane and they are on the outside, i will just creep past them not blatantly looking like i'm "undertaking" them.

On the bike, it's probably because I'm not seen, but I've sat for around 5-10 minutes behind a car before with NO ONE on the middle or inside lane - and I must admit that again I did drop it down 3 gears or so and make a point of undertaking him rather quickly :o Not proud, it's not big or clever, but I did give them plenty of time.

I don't flash though.
 
A "Do not" is not covered by law though and is advisory? Weaving in and out of traffic would be considered careless/dangerous driving but if your lane is moving faster than another than it is neither of these?
It's an advisory, which if not followed allows the police to charge you with Careless Driving these days. The MUST/MUST NOT statements are things that are specific driving offences. The law was changed recently to make it a lot easier for the police to do people for not following the highway code where it's not covered by specific offences.

If the Highway Code says you should be doing something and you don't do it you're leaving yourself open to prosecution. In this case, could you argue that the road was congested to allow you to pass on the left?

coming up behind another motorist and flashing your lights at them would almost certainly be an S59.
If you are sitting in lane 1 at NSL and someone else is in the right-most lane at 60 you are not expected to change lane to pass.

I dislike overtaking on the left simply because they aren't expecting it and I end up in their blind spot for a short while; if they're not paying attention they could easily crash into me. So if I do so, I always do it in the first lane.

It's because people have no idea how to use a motorway. It should be part of the driver training before the cretins are allowed out onto 'em.

Its pretty simple to use a motorway, I really have my doubts that this would help - the guy just likes the idea of being 'in the fast lane' :p
