Travelling along NSL A road @ 6am at ~50, 4x4 pulls out without warning and wrecks car.

Mate was driving and fractured skull and had plate put into leg as was shattered amongst other things.

I was knocked out and suffered a lump on head and 3 cracked ribs.

Had to take a few days off work however due to no sick pay had to go back :(

Currently mates just come out of hospital and we both wondering how long it takes to sort out his car (will be a write off) and damages?

Can I claim for my few days off and anything else?

Cheers!

Edit: The other guy was completely fine and apparently he always pulls out in morning as no one ever on the road!

In answer to your question yes, and yes you can claim for pain & suffering. Any personal injury solicitor would be happy to take your case, but happier to take your friend's case :p

Something like yours will be settled quickly unless there are any outstanding liability issues, with the fixed costs regime in place there is no real incentive for solicitors to drag out the matter. Also check if you have pre-existing legal expenses insurance on anything like your credit card, home insurance etc as you could go through that, otherwise you're looking at a CFA and suchlike.

*in before the ZOMGS whippy crowd*

The claim for the car will be settled in weeks.

Any straight forward costs such as wages can be made as soon as your back at work full time. They'll ask you to prove it (wage slips) etc.

The claim for personnel injury can take couple of months for yours to come through. Your friends could take a lot longer as I wouldn't settle until I was happy with the recovery I had made. So could be 6 months could be over a year.

Jesus, sounds like a hell of an accident, hope you guys make a quick recovery.

Most claims take around 6-12 months to settle as the other party is going to start low.

You have 3 years from the date of the accident to claim for the injuries, by all means see all the doctors you need to get better, money part of it will be settled and all in good time.

Hes just worried about paying bills as will be on SSP for a while and the car impound bill from police is growing daily!
