I WON on a self service checkout!

It might not be theft, reason I think this Is because if you fi to a petrol station, fill up and then go to the cashier with a bag of crisps and give them 70p, if this goes unchallenged its not theft - you have made a reasonable attempt of payment.

Give over. That's not at all reasonable. You're not telling them that you've picked up any fuel and you know what you're doing, ergo it is theft.
 
The dishonest state of mind argument is nullified when the cctv shows you walking up to the pay point and 'paying' it wouldn't stand up to argue theft (my friend used to manage a petrol station and this is his experience) the police review the footage, and decide its not worth perusing. Driving off without attempting to pay IS a different matter.

I don't really want to get into the laws of criminal evidence, but I would suggest that the records showing payment taken of 70p and considerably more petrol taken would alter the interpretation of that CCTV evidence.

What the police and CPS choose to prosecute is a question of public resources and irrelevant to the matter of whether something is a crime or not as a matter of law. All of these are very relevant to whether you are going to be spending time in gaol, but I am purely stating what the law is.

I'm not sure I buy the fraud Argument either, he's just going about his business and buying some food, if he gets too much change, well, that's hardly fraud is it. It could be construed as fraud, but you would need to prove intent.. repeat visits to the machine may well prove intent, but it certainly wouldn't wash for a single occurrence.

Read the OP again (and the Fraud Act)! :p I did say if the facts as the OP admitted could be proved.

I sent her in with another £20 note and told her buy somthing small & use that machine she got some tooth paste used the same machine and got double change too.....

Criminal law is not my speciality, but I am fairly sure that is fraud.

LOL - moral arguments aside, I would risk getting struck off for life for £20? No chance.

Nope we don't all suffer from questionable morals. Not only would I have not gone back a second time, as well as send back the missus for a third attempt at theft but I would have gone to the customer service till and let them know.

Sure I am somewhat paranoid about being caught on camera but the long and short of it is that it is just plain wrong.
 
Or they have stronger morals? I've given back less than 20p when the change has been wrong, don't judge everyone by your standards.

A while ago I accidentally walked out of a shop without paying for a newspaper, when I realised I walked back 800yds to go and pay for it

At diesel pump, filling up a full tank ~90L pump cuts out with about 20L to go. Replace nozzle in pump, reset machine (after asking staff), fill up remaining 20L, then go to tills to pay. Different member of staff asks what pump and quotes me for 20L. I pay for the 20L, and get receipt....

a slight pause... then I ask what about the other 70L I just put in? to the horrified look on the checkout girls face lol

Sometimes it would just be sooo easy to turn to the darkside :p

Good, they deserve it for buying such **** self-service machines.

The only good ones I've found were in the Tesco Extra in Sheffield. The ones we have in Morrisons here are horrendous, I hope they start spitting out £20 notes.

Which Tesco Extra? I need to witness a good self service machine for myself!
 
You realize that when Asda notice the discrepancy they are going to go straight to the CCTV, don't you?

"Please check your change immediately as mistakes cannot be rectified at a later date".

See a similar sign like that in a lot of shops. Seems like an ideal defence in this situation. All they will have is footage of a man buying his shopping and taking his change without checking it.

No, he walked back and did it again, then sent someone else to do it. He did it twice.

The OP buys his food, realises the machine spits double change..
He then buys some gum and does it again...

You're both missing the point.

It doesn't matter that he did it twice. It doesn't mean a thing. He made a mistake and didn't check his change, twice. That's all he has to say, and they cant use CCTV footage to prove otherwise.

He obviously did check his damn change otherwise he wouldnt have done it again. Would have to be a pretty damn thick CCTV analyst to let that slide..
He was probably smiling and giggling to himself as he realised as well. He then went back outside to his motorhome and got his wife to do the same thing.
