There is a pretty good explanation in the Ars feature as to why it only gets 95%.
As such, Internet Explorer's more conservative approach is probably a sound one. It means that future versions of the browser will get better, with minimal risk of breaking anything that works in current versions, while still keeping it relatively up-to-date and current.
This pragmatic approach is also why Internet Explorer 9 will only score 95% in the Acid3 test. The remaining 5% is testing features that are currently under evaluation and may be made optional, as they are superceded by other, better specifications. Implementing features that may be made optional and in any case have superior alternatives is not a good use of resources.
