is smoking legal whilst driving?

It's totally ludicrous.

I don't smoke but some of my employees do. They can't smoke in company car during work hours, even if they are on their own.

Just think for one second...

1) If the car has to be given to someone else because they leave etc why should they have to drive something that smells like an ash tray.

2) If the cars are contract hire from a leasing company....what happens when they go to dispose of it after 3years/60k miles.....oh yeah the value takes a hit because its a stinking ash tray!

Is it only during work hours they are not allowed to smoke in the vehicles? I was under the impression if it was a work vehicle they were not allowed to smoke in it at any time.

yeh...i mean they make cars with ash trays in them so that would lead me to think it was legal. but then again they may see it like mobile phone usage whilst driving, so i wasn't sure.

Not any more they dont!

Unless we just get a modded interior with them taken out down here

Aren't we allowed to smoke in underground carparks?
Didn't know that, I know some coppers don't like you smoking at the wheel but I do anyway, my car and i'll smoke in it if I want to.

smoking cigarettes that is. my mum told me that it is illegal and you could get a fine or something if your at the wheel and having a fag. is this true?

Hrmm funny thing is, i was waiting at the traffic lights next to another guy who WAS smoking, Window down, 1 hand on the steering wheel, The other a fag and puffing away.

Behind him was a police car, Which kept looking at my car( front lightly tinted windows), Not only that another police car was turning right while we were waiting.

So no i don't think it's illegal.

I know what you are thinking, Lots of police, Well i live near strathclyde police station, And asda is across from it :/

I think it may depend on the insurance for the company car. When I worked for ICI the company cars were insured so anyone in the company could drive them, not just the main driver. In that case it would not be allowed for anyone to smoke in them at any time under the present law as it would be classed as a workplace.

I don't smoke while driving anymore. After I dropped a fag on my crotch mass panic set in which almost involved me hitting the central reservation on the A55 in North Wales. If I want to smoke i'll stop in a layby.

I've done rummaging around for a scolding cigarette lighter. Hadn't told my sister that it likes to launch itself when it's hot enough.
