Is this discrimination at work?

So you have a problem with someone who has worked at a company for 5 times longer that you earning less than 3 quid an hour more than you? My word.

Actually his problem is with that his role has changed but his contract and renumeration has not been changed to reflect this.

Even within this context I'd have expected a bit less of a gap - in a similar kind of role where I work you'd be talking like 90p/h difference max relevant to experience for those kind of roles.
 
When you say public sector do you mean an organisation that uses defined pay scales with spine points within the grades? If so there is no question you should be on the same scale/grade as your colleague but I'd expect them to be further up the scale on a higher spine point than you due to length of service.
 
If you've several years less experience then it's not discrimination. If you came into my job role with no prior experience and earnt the same as me I'd be shocked and annoyed. It doesn't matter if we've the same duties or not.

However it's worth raising the point if you're earning much less.
 
It might also have something to do with your age as for some reason even with the new working wage under 25's get paid less.
Are the others over the age of 25? if so then your boss might say its because you are under 25.
I understand that you are paid more then the working wage but it might just be the mind set.
But as others have said you should be paid more with your job role changed.

At my work I get paid more then other people doing the same job but I have been there 23 years or more I lost count at 20 years.
But when I started we used to get a £1,000 bonus every year when they stopped it I pushed my luck and told then that it was a cut in my wages so they gave me a pay rise to cover the short fall.
Then they cut my hours back from 45 a week to 39 a week but I was again given a pay rise to cover the loss in earnings.

So anything could have happened in the 15 years that the lady has been there.
 
She's been there 15+ years. I've been with this place for 2-3 years now.

It's public sector.

You'll both be on the same pay band, which has 6 or 7 'notches'. So after 6 years, you will hit the ceiling for your pay band. With 15 years service, she will have hit the ceiling 9 years ago and will have been stuck on a similar wage ever since (albeit 1% pay rises if she's lucky). You, on the other hand, still have a few years to go before you hit the ceiling, thus why you're on less than her atm.
 
You're not being discriminated against if she's been there 12 years longer, but you're welcome to ask for a pay rise. There's a noticeable difference between earning £8 an hour and earning £11, it's quite a big gap
 
If you're asking for a payrise, don't ask based on the "they're getting paid more than me..." angle, tell them why you think you're worth more than you're getting paid and what you offer to the company to justify it.
