Is this false advertisement?

That's like saying there is no download limit, then saying there is a download limit of 20GB.

This is exactly what nearly all ISPs say anyway.

"UNLIMITED! NO DOWNLOAD LIMITS! DOWNLOAD AS MUCH AS YOU WANT!!! *subject to Fair Usage Policy, use too much unlimited bandwith and we might complain or try to charge you lulz*
 
I'd be very surprised if that was deliberate. More probable it's a case of poor internal comms within their organisation. It's just too blatant. As someone else said, they've not even tried to call it something else.

edit - so no, imo it's not false advertising. But then someone may or may not have to prove that.
 
ive seen Sky advertise their broadband as unlimited tonight - same ad loads of times (crap one with musketeers), ive even purposely looked for smallprint at the end of it - knowing full well that there really ought to be some.

The average man/woman in the street would surely watch that ad and assume that they can use unlimited internet as much as they can without restrictions when it really isnt true.

Im not blaming Sky alone in this, most have similarly misleading adverts
 
Skys unlimited package which is what the main jist of that advert mentions, does not have any limits or throttling on it (If you think your Sky unlimited package is being throttled then you have a problem somewhere else).
Anytime plus would be a CS nightmare if it wasnt the case that it was being throttled or letters coming through the door saying your using it too much.
So people who sign up to Skys unlimited package would be right to think that they wont be limited or traffic managed.
If sky dont have their equipment in your exchange and your relying on BT wholesale then thats another matter totally, but that advert isnt for the connect package, so no not really misadvertising on skys part there.

I'd guess that the first link is out of date and they've subsequently introduced a fair usage policy.

Actually the opposite of this!!!

I have basically been forced to cancel my Virgin fibre connection as our new house does not have it available.

Our new house is outside the LLU(?) area so the can charge us more. Virgin wanted £40. I am with Orange mobile so called the Broadband line, remembering this thead I asked them about their FUP they confirmed that they are REMOVING(!) the fup. Basically to get an edge over the competition. I mentioned the T&Cs and he said that he will look into it and try and get it changed, it will most likely be because it has only been 2 weeks.

All in all it is going to cost us £29 a month for phone and internet, which is not bad considering everyone else was £35-£45 a month.

I will report back if they are telling boo boos about the FUP.

Tried Sky, no FUP on the full unlimited package and you get half-price line rental with that. £30 a month.

Wanted sky as we are getting the getting the tv. Unlimited not available at my new house :( Neither is Anytime+ nor any good Virgin service.

Depends what is 'unlimited'. It is reasonable to assume they are referring to the ammount you can download, given that packages will be listed as having download limits, with some being unlimited. Thus the unlimited refers to how much you can download.

Thus they are unlimited, with regards to how much you download. The speed is limited by the FUP, but you can still download as much as you like. Thus it is unlimited in that respect.

The speed they say is 'up to', isn't it?

Edit: I'm not saying I'm agreeing with their policies, just that, well, its not false advertisement in my eyes. The broadband speeds some people get on 'up to 8mb' services can be downright pathetic, and something deffinately needs to be done about the infrastructure to improve it.

hough it's not up to if they're limiting you to a lower number it's only "up to" that limited figure.

Limiting ones bandwidth limits the amount that can be downloaded thus it is not unlimited in any respect.

Sorry for any confusion! I've fed this back and have been advised that we are currently in the process of updating our terms across all areas to reflect our current packages.

In the meantime, I can confirm that there is no Fair Usage Policy on our current broadband packages and any customer joining us after April 2009 can download as much as they like without fear of hitting any kind of cap. Some customers joining Orange before April 2009 may still be on old packages with a fixed monthly limit and this fixed limit would still apply for those customers.

Orange are renowned for doing stuff like this to be fair. When I was quoted my pay monthly mobile cost on the phone, they quoted me the none VAT price, naturally making my bill more than I thought, especially when comparing to competitors...
 
with regard to the buffet analogy, they let you eat as much as you want, they just make you eat slower.

Dont see the problem with it really, My vm(50mb) has fair use but i dont seem to get capped and i download stupid amounts of steam games/ streaming and other legal stuff ;)
