Update time. I emailed SplitFish and they responded back with this:

Yes about 3% of all the units need a firmware upgrade.
This will ready in two days.
It is not a hardware issue.
Both units are doing the same thing right?
With the firmware comes the new analog button calibrator.
You will then be able to tweak R1 and R2 and all the analog buttons to as
sensitive as you like!
Or of course we do not want to have any unhappy customers in the market so
if you like can arrange a refund for you?
But before you take the refund, try the firmware upgrade and see if this is

My FragFX came in as well today. I must say I am extremely disappointed and found the IGN review misleading. The Movement is NOT like a mouse at all. The sensitivity is adjustable but the Lack of range of sensitivity that usually makes Mouse aiming more accurate is NOT there. I am going to return this product right away. It's really disappointingly this Review did not cover it and this item definitely does NOT deserve a 9.1/10. If you're buying this because you love mouseaim on PC games, don't. I agree with Postal, i just got the FragFX today and at first it felt really jerky and hard to manage, but in Resistance i just put up the ingame sensitivity then put the FX at about 3.5-4 and it solved my problem. might use a bigger surface for more freedom than the included pad gives. As for the buttons, for now you just have to squeeze them a little harder but hopefully the firmware will fix that. my figers are crossed that the firmware will increase the refreshrate on the tracking for variable mouse speeds as well.
For now i'd say this is worth the buy if you are a PC gamer frustrated with those damn sticks. I felt at home when in RFOM i got a 5 kill all in up close headshots while they were wildly turning around tryin to keep up. This is a step in the right direction. Yeah, Im using a FragFX and love it. The jerkiness is just a matter of getting the sensitivity settings just right. This is because most of the games out today for the PS3 arent made to work with a mouse. A game like UT:3 that is made to work with a mouse will show its true potential but you can make the jerkiness almost nonexistent with the right adjustments on any game.
Also as per the buttons being non responsive. Well SplitFish is working on a firmware update right now that will cure that problem. The update will give the user the option to configure the button layout more to their liking and also make it so you can adjust the buttons sensitivity levels so they are very responsive to the slightest touch. The update is expected out very soon.
So all in all while it may not be like a PC mouse it is a step in the right direction and will more then likely pave the way for more things of this nature. For me this thing works great. It just takes some fine tuning and some practice.
If you do get this just give yourself some time to get use to it. You will like the end results.

I returned mine within 30 minutes of using it the first time. I'm about as shocked as everyone else here. This thing is a real piece of crap. I had the same problems as everyone else with the mouse stutter and unresponsive buttons. I'm not about to waste my hard earned money on something that just doesn't work. Sadly I have to concur. I am so disappointed by SplitFish. Did they not do any quality control? I'm curious if they sent a *special* model to IGN Gear and not a mass produced one. Didn't anyone make a random grab/test.
Mouse buttons work some of the time. I've tried two separate ones due to an order mix up and both have the same issue.

What I would like to know MORE than anything is WHERE IS THIS SOFTWARE ON THERE SITE?? It states in the manual that the Analog and I quote "You can also re-map all the buttons,as well as adjust all the analog buttons sensitivity". After reading that I went right there looking for this "software" as it might solve the R1+R2(LMB+RMB)button problem as being unresponsive most of the time in game without really pressing down hard.
I have emailed the company asking where is the software,but I'm not holding out them getting back to me as I asked them a question weeks ago and I'm still waiting a response lol.

Ya, I just got mine today. I can't express how disappointed I was with it. I guess I was expecting true PC gaming, but all I got was large, popping movements with the mouse and a nearly unresponsive left mouse button. Also, in "true mouse mode" it is imprecise as it gets. That is unless you set the sensitivity so low that it's a chore to use. What's sad is the actual analog controller seems to be more precise than this thing.
Oh, I've tried various sensitivity settings in-game, on the controller, etc, with no success. Either it's too slow, or it jerks around. Also, being able to fire back at the enemies would be a nice feature as the left mouse button works 50% of the time.

mine arrived today. it's definitely a stretch to claim this thing offers PC accuracy. build quality is also questionable.
