Is this yellow line enforceable?

Because the evidence points to it being a stupid place to park. So she deserves the ticket. I hope the appeal is thrown out.

Yes its a daft place to park, I fully agree, but if councils etc will invest money to uphold parking etc, then they can at least invest the money in maintaining the road correctly too.

to me that looks like the line ends where the freshly painted bit stops, seems as though the rest has been abandoned. Regardless of it being a daft place to stop, i'd appeal.

With that attitude where do you stop? How do you know that road isnt planned to be relaid?

From that picture if she had parked there she would have been obstructing the road. She deserves it.

Stop trying it on.. anybody who fails to spot the double yellows needs their eyes testing and shouldnt be on the road. Everyone wants something for nothing..

I would contest it as it is broken to me. And Oblivious you made your point I am sure none of us would do such a thing :p

If it ended it would have a yellow line across it like the white one. Still worth challenging the ticket though.

Best bit is that *if* the faded line is deemed unenforceable then the freshly painted section is as well because it hasn't been properly terminated.

Also depends how close she was to junction, as according to the highway code, your not allowed to park within 10metres of a junction, and there is a solid, but faded line in that pic.

Right, lets all calm down shall we.

For the record, the junction is at least 30m away and the hatched area is bounded by broken white lines, so perfectly safe & legal to cross onto.

The line in the area where the car was parked is very faded, it should be as clear as the solid yellow part at the bottom of the picture. There are no signs or kerb markings to support the line. The yellow line is there to protect the junction but it is not clearly marked.

My wife was in a hurry to make it to an appointment with our baby so she grabbed what looked like a perfectly viable place to park. Gets a ticket for parking on a yellow line. "What yellow line?" etc etc.

Appeal it, line isnt terminated correctly, line aparantly ends with the fresh paint and original line is barely visable.

From most posts on this forum you guys walk around with halo's above your heads.

You should almost certainly get of with it. How does one actually go about apealing these things? Do you just reply as you would the ticket, but attatch a nice letter saying "not paying and heres why:"?

I wish we didn't have this crazy thing in our society where every time we get caught doing something we know is illegal we try and get away with it. I'm sick of hearing about people contesting speeding tickets and now it's moved onto parking on double yellows, does my head in if she parked there she was wrong take it on the chin and pay up.

Maybe if we didnt feel like 98% of our pay packet was going to them in the first place we wouldnt?
40% tax on pay packet (IT and NI)
Road Tax
Petrol Tax (~65%)
and the rest of it they want for parking offences and going a smidge too fast :p

Firstly, it was a single yellow line.

Secondly, my wife didn't park there "knowing it was illegal". She did not see the badly faded markings and therefore parked there believing it to be perfectly ok.

You speed & get caught, you pay up. You knowingly park on single/double yellows & get fined, you pay up. You park where the restrictions are not clearly marked, you should have the right to legitimately contest the penalty.

Meh, just stating my opinion, I hope the fine sticks and if it were up to me I'd double it for the waste of time and effort.

Appeal agaist it. The line is bearly visable, I saw some guy (on tv) get off with parking spaces he illegally exploited in that they wern't upto the correct specification.

There are rules to how markings must be placed and thier visibility, if they aren't correct then there probably void.

If I'd seen that on the road, I'd have not realised it was a current yellow line - far too faded. Appeal it.
