My fabulous ship
Hi guys,I sold my 42 inch samsung lcd tv (good condition), creative labs dts decoder (good condition) and 7.1 surround sound speakers the other month, before I sold it I realised I lost the plug for the sub, I told the buyer he could take a different set of 7.1 speakers or try to repair the initial set, or I could knock off some money or just not take it, he decided he would repair it and if it was broke I could refund him within 3 months.

a month later he has just text me back saying the sub is broken and he wants 100 for it.... but get this. he's thrown the sub out and wants 100 for a new one.

I'm sorry but you don't go to tesco say "oh hi I bought a tv from you,but it broke, so I threw it out and now I want a refund".

btw he wants 100 to just replace the sub, the speakers are fine - so 100 for a sub? that system isn't worth it

Off the top of my head;
Was there any refund option in the auctions? or did it say 'No Refunds'
Also, isn't the window for dispute 1 month?
All you could do is offer a refund upon the receipt of the goods back which he can't do.

I know you said you'd refund him with a 3 month window, just say you need the unit back or no refund. I think he's SOL.

Definately say you want it back to see if you can have it repaired, ignore the fact he's binned it. Generally speaking if something is faulty you have to take it back to where you bought it from for them to try to repair/replace it, you don't simply demand money for a new one and that's in high street retailers, not second hand auctions.

the auction itself said no refunds and recommended the potential buyer to visit before buying which he did. I offered him the options and he chose to try and repair, when he couldn't he asked for a refund which I accepted and said for him to return it - then I was told he binned it.

He's threatening to go to ebay but I would like to hear what they have to say

In all probablity it works fine ( he fixed it or whatever ) and hes now just trying it on. After a month he wants a refund? is he joking....

Well, you had factored in the possibility of a refund at the time of sale, what value did you have in mind at the time?
(In a situation like that the best thing to do might be to sell the sub as 'untested' or 'faulty')

He hasn't got a leg to stand on, he's bought it and now the honeymoon period has worn off he would rather have the money in my opinion, let him go to eBay..

was thinking of £75 - the system is over 5 years old - not worth 100 for the sub alone, which is what he was trying to get.
