Well firstly hi from sunny butlins in skeggy.....

Anyway last week i got a camcorder to do some videos of my sons first holiday.

It was advertised as a full HD 1080p camera with 4x digital zoom and 23x optical zoom. The advert also mentioned it has a HDMI connrction.

Well ive used the camera this week and the quality of the videos is terrible. The audio distorts and unless youre in brillisnt sunshine the videos are dark, even in normsl indoor light. The menu system isnt very good. Basicaslly i expected better.

So i think no problem ill return it when i get home for a refund only to notice it csnt ber returned under the money back guarantee. Which is a bummer.

So can i return it under my statutory rights? The ressons being that,

1. Its useless for 1080p with very laggy video asnd missed frames
2. It doesnt have the asdvertised HDMI out
3. It only has 4x digitsl zoom and no optical zoom at all?

The advert does say i may get a substitute of equal spec. But what i got isnt the same as whats advertised. It was bought instore so cant be DSR'd.

It says in the advert its a Vivitar DVR 1240HD, i revieved a DVR 1080HD.

Any input appriciated.
 
If it was advertised as having HDMI out and 23x optical zoom, and the product box you viewed before purchase confirms this, yet the product in the box does not have this, then it's a cut and dried case - refund, no issues.

If it was advertised as having these features but the box you viewed before handing over the cash did not advertise these features then it's more complicated but I'd imagine you still have a case.
 
where did you get the camcorder from? if it was from some dude at a car book sale then no.

It was from a high street catolouge store and the bottom of the reciept says its exepmt from the 28 day money back guarantee.

I didnt see the box my recieot was stamped and it was bagged up.

Are you sure it doesn't have HDMI out? It won't be a full-sized HDMI socket.

Also the fact that you thought a £50 camcorder would be good quality in low light, have decent audio and a decent HUD is pretty naive.

It _should_ have a mini HDMI output socket - usually has a rubber bung or flap over it. Do you have the original box with the catalog number on it? theres a chance someone picked the wrong item and it wasn't noticed at collection.

Reason for being exempt is due to people buying them for a holiday or wedding, etc. then returning them when they are done - effectively renting them for free. However if you can show that the item you got was significantly different from what you thought you were buying then ask for a manager and they will almost certainly refund it.
