Question re warranty on a lease car

My bother has a E class which is looking at a significant bill

The issue is the fault occurred within 3 years of delivery but the car had been registered about 6 weeks earlier, wondering where he stands on this one

Thanks

Is it not a moot point? It's not his car. The fault isn't caused by damage ergo is it not up to the lease company to sort?

I'm pretty sure the distinction between a "lease" and a "rental" other than the timeframe, is who is on the hook for keeping it roadworthy... it is always a risk leasing a car outside of its warranty period.

Guessing it all comes down to the ts and Cs.

Unfortunately this is the answer to the OPs question as well.

My Yokos on the E43 were toast due to perishing. I had only had the car a year or two; the tyres were manufactured 4 years before -- Merc and their dumpster class Customer Service couldn't give a toss. So I think that is your answer...

I guess you could get it repaired and then ask the lease company to contribute?

he assumed a 3 year lease had a 3 year warranty, car has a 3 year warranty but they registered it quite a bit before the lease was taken out and he wasn't informed

It is tricky right... if you follow the black and white:

So the warranty was started when the car was registered... when he took the lease seems to not feature in the story.

Is there any way to "hide" the fault and return it?

yep, car registered 6 weeks before he took delivery

fault is pretty solid

I'd still push the lease company.

If it's advertised with a 3 year warranty, it should be 3 years from the moment you receive the vehicle, not 3 years from when it was registered.

I think that's the way it's heading
unless it said something like 'remaining balance of manufacturers warranty' like you would get with a pre-reg if buying. If it said straight up 3 year manufacturers warranty then it should hopefully absolve the lessee of any repair. Hopefully it doesn't get drawn out too much.

As an example... it just points to the cars warranty. So if the cars warranty is X then it is distinct from the lease...

yes its said "3 yr warranty" it was not a pre reg just the 1-2 weeks it took to process
