Letter from solicitor threatening county court proceedings

Has anyone thought perhaps it has taken 18 months because they have been trying to contact the wrong insurer/owner,
and then the owner of the other car could have been ignoring letters from their insurer because it had someone else's name on it on it or the insurer has been rejecting the claim because it has the wrong name on the claim.
That's why it's a requirement for both parties to notify their own insurance company, highly unlikely both would be wrong details.
 
June last year and now they’re writing to you?

Tell them to do one. Who’s to say they haven’t bashed their car in the local supermarket and now want to use you to pay for it.
 
Thanks for advice folks we approached our insurance company who now have a copy of the letter and will take over

If they had incorrect registration and vehicle details and didn't know who the insurer was, then they had no chance in court.

I would hope that your insurance company plays this out properly and doesn't just fill in the blanks.

Then that would be their fault. It isn't your duty to help someone else sue you for damages.

All they needed was the correct registration and they could have gone to their insurance company who would be able to immediately find out who the other insurance company was (as long as the car was insured).
 
I would have just ignored it. Unless they have a photo of obvious damage with your father's car near they would have no way of proving it.And after that time period it would be very difficult to prove and I wouldn't image it would stand up in court.
 
ambulance chasers i bet.
ever since i've had my accident i get phone calls about it. telling me i'm entitled to up to 3k compensation for a minor discomfort claim. in my case google suggested that 3k would just go to small claims court with the other parties insurance just usually paying up. wish these companies could just go rot in hell :o

Not uncommon for injury solicitors to get wind of it through the insurance company and call the injured party when they're still in the hospital. Happened to a guy in work... his mrs had a bump and no sooner had she got to the hospital, they were calling him! He basically found out because of their eagerness to chase the cash!

yep smashed my car up 3 hours later had the first calls.
still getting calls now, 5 years later. :mad:

wish i could sue the lot for the constant harassment.

One of the smaller insurance cos I worked for used to sell the list of claims to a firm who would then progress. I think this is now banned. Can't remember specifically but it was something like £50 per claim we advised of.
(obviously we only sold the ones where we didn't believe our policy holder was at fault)
 
It just all proves the car insurance needs a shake up. To many crash for cash claims and pointless injury claims. Getting like footballers, tiny bump and the people fall out of their cars like they've been hit by a train all so they can claim injury. Then the same people moan that insurance costs too much. If only we could get a quick repair quote and insurance just pays for it cheaper all round.

I had a fault claim years ago where I wrote two cars off and damaged another, each car costing no more than £6k each. The final cost was north of 80k.

Happened to us. Girlfriend shunted into someone at a junction in my car - we're talking very low speed, her foot slipped off the clutch, the car stalled and jerked forward. Big damage to the front of my car, almost none to the back of theirs. Details swapped, all very amicable - unequivocally her fault, so held our hands up and went through insurance.

A couple of weeks later, we get a letter stating that the driver is suing for whiplash - despite having taken no time off work, nor consulted a medical professional. Just an automatic attempt at getting some compo. I couldn't physically see how a car the size and weight of a GT86 could possibly transfer enough energy at walking pace to shunt a Ford Ranger pickup hard enough to cause whiplash so I informed my insurance that we suspected it was fraudulent and said that if they wanted to challenge it, we'd go to court as witnesses. It seems the other party's case was built upon using the cost of damage to the front of my car (which was quite extensive) to claim that the accident had occurred at a higher speed than it actually did. In the end, I think our insurance company settled for an amount smaller than the original claim, but they said that if I hadn't contacted them to query it, then they would probably have just paid the original claim in it's entirety.
 
Same here, guy slammed on for no reason was a complete **** of a person just looking for trouble.
Mr's car (Mini) hit his tow bar (rav4) no damage to his car, hairline crack to her front bumper, litterlay just resprayed it, 2 small to even bother filling.

2 weeks later whiplash claim, we contested it, had people out to check damage of car etc, lucky we had photos of the day... The inspector laughed at the damage.
Also had 2 witness's of how he was driving and caused the accident, even thoguh she went into the back.. His claim was rejected by the court & he had to pay costs to the insurance legal team.
Karma.
 
Insurance companies made a rod for their own back, a number of years ago they were all content taking commission from referring non fault accidents to ambulance chasers who would then go after the at-fault party for whiplash compensation. Unfortunately none of them had the sense to realise that this would come full circle and soon the whole market would be doing it and it would drive average claims costs through the roof. The referral schemes have to my knowledge all ceased now, but we're still dealing with the fall out. We are going to have to wait until 2020 for the whiplash reforms to see any real impact.
 
What I don’t get is that in the last 20 odd yrs of driving I haven’t *touch wood* had an accident but every week I get calls on my mobile with some foreign sounding person saying that I’ve been in an accident and if they could take some details.

I usually just hang up and block the number.

I have had no less than 3 such firms contact me off the back of it, trying to convince me that I’m injured (I’m not, it was just a few mm too far over and clipped). They’ve also all offered me hire cars at ridiculous rates - around £400 per day. The only people who know about the accident are my insurance company and the other driver’s.

Who repaired your vehicle? Did a supplier give you a courtesy car? Have you gone and done any online quotes with the claim?

My car is currently at the local bodyshop. Maybe they referred it on? I can’t think of anyone else who would know. The most annoying outfit is Auxillis who despite being told in very clear terms (a polite **** off) keep calling.

The third party insurer have outsourced the replacement car to Enterprise which I have taken.

Its possible that official referral schemes still operate, I wouldn't completely discount it, but from what I understand the industry was supposed to be moving away from it.

However people are people, and its entirely possible that your details have been passed on unofficially by a rogue claims handler for a back hander.
