M4 not updating and odd random start issue

Spent the weekend finally setting up my new 256GB M4 from a slightly older 128GB M4. It is running the 010G firmware which had some issues cant remember what so I wanted to update the firmware, but the firmware software keeps saying can't find any SSD. I am running on W7, my Mobo has UEFI BIOS and I have one other device attached which is a HDD. Anyone know why this would be?

Secondly, when I switch the PC off on two occasions it has randomly switched itself on and gets stuck on the POST screen where it displays the drives it detects, it also does that on cold boot.

My Specs are:

W7 64bit Pro
ASROCK Z77E-ITX
8GB DDR3 Corsair Vengenance
Intel i5 3570k
AMD HD6850
Sugo SG05 450w SFF
Crucial M4 256
WD CB 1TB

Have you tried plugging it into different sata ports ???

Edit: Looks like your board has 5 sata ports..
