Magic Mouse and Lag?

I have a late 2009 MBP spec as follows:

15" MBP
2.53Ghz Core 2 Duo
4Gb Ram
320Gb Hdd

I also have a wireless desktop with the apple keyboard and magic mouse which generally work fine. But I sometimes suffer some serious lag when using the mouse, it becomes near impossible to use and it doesn’t matter how far or how close I am to the MacBook when using it. This is also the case for the keyboard at time the keystrokes are trying to catch up with themselves :(

I have tried new batteries etc but doesn’t help. Is this a known issue?
 
Sounds like you're either having interference, or the receiver module in the computer could be at fault.

Call Apple, or visit a store and get them to look at your keyboard and mouse first, to rule them out.
 
I have read elsewhere that it could be to do with my router due to the fact it uses the 24Ghz band and the mouse and keyboard use the same its causing the problem. It was suggested I upgrade my Dlink DIR-655 to a dual band but seems an awful gassle just to get a mouse working :(
 
Try changing your router, to use another wireless channel (such as 1 or 11), as most devices use channel 6.
 
I had this problem, no amount of changing on my router fixed it, so I returned it :( really wanted the magic mouse to work too! Instead bought a Razer Orochi and it works fine over bluetooth.
