Max Spielmann copying my photographs..where do I stand?

yes they know that a photo has a copyright on it, but unless you put a stamp on it saying the copyright belong to you, how in hells name will they know who it belongs too. it not as if every tom, dick and sally doesn't own a digital camera good enough to take a photo. had mr tommo put a stamp on his photo with his name and a contract no then max could have phoned him up to see did this lady have the copyright to that photo or not, what more if he did decide to take max to court his case would be much stronger

taking photographs that she had bought from us from her childs nursery (the photos were still in our logo'd mounts) and asked the member of staff if she could make a canvas by scanning one of our photos.

Depending on the logo I think it would have been fairly obvious that it was a professional shot.

However, judging by the reaction from the the local branch and even the area manager, I don't think it having it in massive marker pen on the back would have made any difference.

I agree though, and already suggested labels or stamps are a good idea in all cases.
