i didnt realise what he had done until the back end of his car was level with my bonnet. The last i knew of it he was behind me. So no its not my fault as much as it is his.

I was on the correct side of the road

He was on the wrong side of the road performing an overtaking manouvre not me, and i presume he was speeding to get past me.
 
the insurer will say there is a break in the chain of causation and will not want to pay out. it will be very hard to prove and i doubt a judge would look too kindly on the whole silly buggers thing too

That MrLOL sounds like a good idea, i was planning on doing something along them lines but explaining to him that his mum would loose her no claims. Your way of wording it is much better though, explaining the policy holider will loose their no claims will give him some food for thought.

people assuming i was playing silly buggers is starting to annoy me now. if i said i was aged 40ish coming out of the office car park would you all make the same assumptions?

ive helped you because your 'mate' is a bit of @!% and needs to grow up

but the fact of the matter is, when you saw your plonker of a mate pull up at the junction on the wrong side of the road, you should just have let him be a plonker and pull off first. If somebody pulls a stunt like that, you know they're going to try and cut you up. So you dont even try and pull of, because this happens.

We're not here to debate how much you 2 were racing, but by your own admission "I wasn’t hanging about". Quite frankly, if i'd somebody pull a stunt like that, i would have been hanging about because i'd have seen this comming. Your young and inexperienced, and you'll learn.

But dont be supprised when people interpret "I wasn’t hanging about" to mean "i was racing him"
 
i prob should have explained a little bit better but when i pulled up at the junction he was behind me...both of us stationary. He must have then pulled past mid turn.

When i said i wasnt hanging about what i meant is i wasnt driving like an old dear but i was by no means racing. The road i was in was in the middle of a terraced housing estate, very narrow roads with cars parked on the opposite side of the road.

MrLol that is by no way a dig at you, i appreciate everything youve done to help me. Im just trying to make it a little clearer to anybody else who may read the thread :)

The other ex had some idiot come round a corner wide and she swerved to avoid a head on smash and did both p/s tyres, it cost her (ok read 'me') 2 tyres and a new set of whel nut's (£220+). If he's any kind of human being and it happened as you say he shouldn't have a problem stumping up a smaller denomination each month.
 
well its cost me £65 for the tyre and £25 for tracking...So £90 all in.

We agreed halves....so £45

He gets paid weekly...Whats £10 a week for a 17 year old who still lives at home and brings home approx £13.5k yr?
 
He's being tight and hoping you'll forget about it ;) everyone tries to get out of things even if they are at fault. Its the way of the world but agreed your both young and inexperienced drivers (not saying im not old or experienced before anyone says :D ), it's got to happen sometime and hopefully lessons will be learned!

By the way.. £65 a tyre? Is it made out of gold? Unless you have a fast car with big tyres then sorry!

Thinking about this tell him you agreed on £45 and if he can't stick to his side of the bargain then you'll notify the insurance co and be done with it, his excess is going to be more than that and he's got the fronting issue to worry about as well ... for £45 he'd be an utter idiot to call your bluff.

Go and speak directly to his mother, highlighting the point of her no claims should sort it out sharpish I would have thought?

Tyres are 195 45 16's, quite expensive as theyre Goodyear Eagle F1's. But i like to have decent tyres as theyre the things holding you to the road.

Well im not going to try and ring the lad again now or make any form of contact with him until i see him at college on Thursday at which point im going to make him deal with me face to face. So far hes always tried to deal with it through text eg i phone he doesnt answer but will txt 5mins later.

Ive spent the monet now on the new tyre, balancing and tracking. I dont miss it anymore as ive been paid since...however its a matter of principle. My alloy still needs a refurb but couldnt afford that as well this month as my car needed a service so tempted to price that up and charge him in advance.

I wish i could get in touch with his mummy though as im sure she wouldnt be happy if she found out hes driving like sucha clown especially when she finds theres a possibilty of loosing her no claims. Ill have to see if any of the other lads know were he lives.

My other school of thought is take his wheels hostage till he pays up lol (only kiddin i wouldnt do anything that could end up with me in trouble)
