Minor car crash - Who's at fault?

He quite simply didn’t see your mate because he had other things on his mind.

If he can’t talk to the insurance company you can deal with them through letters.

The guys telling lies the insurance company would not have told him that, he could obviously tell your mate was or a slight nervous dis position so he’s playing on it.

If you have a facility record the phone calls stitch him up using his own words.

If the blue arrow was turning right it should have given way to the red arrow anyway.

If the blue arrow was turning left it should have seen the black box and the red arrow, and given way to the red arrow.

if he's a bit shy like that, then why not call up for him :)

On a bit of a side note, is this allowed? It's too late for this case as he's now rang up the insurer... Hopefully his dad will have helped him... But for the future it'd be useful knowing.

I always thought the insurer wouldn't much like it... Possibly they'd think you're going to be a bit biased? Reading that back it sounds silly, because whoever rings it's likely to be slightly biased, but I know what I mean... Hopefully you do too. :o

To be honest that does not look anywhere near as clear cut to me as some people seem to be saying.

Where exactly is the damage on the blue car , the point of impact, was the blue car indicating these things make a differance

Frankly if your going forward towards a junction and a car is indicating to come out towards you and you cross in to his lane ....

The obsticle (the van) is on your friends side of the road that actually negates right of way as far as I am concerned. 50/50 actually seems fair to me.

Ah but it's not a junction, it's a drop kerb. That makes a huge difference and I beleive in this case determines the fault. It would have been 50/50 had there been a junction with appropriate markings. As it stands the blue car leaving from a drop kerb is joining the road with no right of way himself. Your friend could not have been expected to give way to a car that is not even on the road yet but still on private property.

It's not a junction, it's a dropped curb so the person leaving the car park had no right of way at all. Also how do you know the car was indicating at the time?

The red car has passed over a section of diagram 1004/1004.1 marking. A driver should only do so if he can see that it is safe to do so. Neither vehicle has automatic right of way

If the red car hit the blue car then the red driver cannot have been able to stop in the distance he could see, therefore, red is more at fault. If the blue car went into the side of red car then the blue car is more at fault. Either way sue the van driver for causing an obstruction.

Nobody has the details of the unloading van. In anycase, it is very typical to see a van unloading on that stretch of road and happens several times daily... I don't think anything can or will be done to stop that.

For now at least, I'd imagine they are both trying to claim off each other with no intention to persue the van... I'll hopefully get an update on Monday.

Meh, silly hill on the campus.

Witnessed some silly girl spank her mini cooper by turning into a guys door as he came down the hill to the North of that pic. Never liked being driven around teat campus, damn students :p
