Missing Game... Call Nintendo?

My Dad bought my Mother the new brain training game as a Xmas present from an airport duty free somewhere, but it was a little while ago that he picked it up. I'm not even sure where exactly it was he got it.

Now my Mum just opened it... it was totally sealed in the cellophane wrap, which doesn't appear to be shrink wrap like when stores put it on themselves.. it looks like the type that is put on by the manufacturer.

So anyways, there is no game inside it!

Anyone had this problem before?
Is it worth trying to phone Nintendo?
 
You can try, but they'll tell you to call the shop as your contract is between you and the shop. Moreover, you only have your word to prove you are not trying to pull a fast one for a free game.

That said, its worth a try, they can only say no.
 
I have had that happen to me before twice. Once an a C64 game Afterburner, where the game was sealed but the 5 1/4 disk was missing. And then 2 years ago I bought the Die Hard Trilogy from HMV and it was all sealed, but the Die Hard 2 film disc was missing. Had some funny looks when I took it back to the shop, but they give me the disc.

Try Nintendo 1st. I had Afterburner replaced by the games company and compensation of a free game.
 
Happened to me with a PC game ages ago. Got it sorted at the shop, not sure what Ninty will do tbh.
