Am I being unreasonable here?

I purchased a 2nd hand blu ray sealed from a forum member on another site for £6 approx, we understand it to have gone missing, so I suggested he can claim funds from royal mail to cover his loss and purchase the same sealed item from a popular American site and have it shipped to my address for £10 approx.

Instead he has simply refunded my cash leaving me potentially (from the PayPal email) that I am down around 50p from the PayPal gift fees and now have to find a source to repurchase the item.

Pretty normal just to refund if an item goes missing, thogh i would have refunded the gift fees as well.

There should not be any paypal gift fees.

Even so, the Royal Mail claim will take 3 months. I would refund, as said by others. Why should the seller send you a £10 BluRay when you only paid £6?

Me personally I would claim for the value of the replacement for the buyer from royal mail, if the value has now gone up then so be it, usually if you buy from an online store in an offer and it goes missing they just ship another one, surely this is why royal mail allow upto £34 to be reclaimed, to cover fluctuations in paid, replacement and perceived value.

Generally, that's not how insurance works. If my car were to "go missing", my insurance company will only pay out it's second hand value. Why should this be any different if it's a second hand blu ray?

car insurance is one of the only insurances that does that, as there is a recognised used market for cars....not really so for blurays!

My camera insurance and home insurance for example is new for old.

I knew that home insurance was an exception, and to be honest my knowledge of other insurance policies is limited. Maybe I'm wrong then, but it still sounds a bit cheeky expecting Royal Mail to pay out more than £6 when you've just agreed that's what the value of the item is.

He's not an online store.

No.. It allows the value of the item to be claimed. He can't claim £15 for a £6 item and say that he needs the extra £9 to cover postage and price differences.

He doesn't have any obligation to replace the item, he's refunded your money.

I have had a similar situation in the past - but there was a whole lot of miscommunication on my part really, so I did increase my refund slightly to allow the buyer to purchase the item I sold (second hand I may add). As far as a second hand dvd for £6, he had prob only made £5 from the sale, and you are asking him to fork out a further amount and go through some hassle. I'd have just refunded too

Yes, you are being totally unreasonable. You object to being 50p out of pocket but would have him £4 out of pocket through no fault of his own. How in your mind is this reasonable?

My thoughts exactly, why would he go and purchase something for you at a higher price cos RM screwed up.
