MOT Question

My MOT for the BMW runs out on Sunday, I am selling it on Tuesday to a man from the ROI and I cant be bothered to get it MOT'd. He is going to drive it back to Ireland and get their version of the MOT done over there. If he gets caught driving it without an MOT in the UK, whos problem is it, considering that he will have all the registration documents handed over to him and would have it signed over to him too?
 
i'd have gone with his fault as he knows it wont have a MOT doesnt he? if you havent told him that it wont have a valid MOT when sold then you could be held responcible i guess?
 
The car is his responsibility from the date he signs the V5 as long as that date can be proved. The decision will fall apon his insurance company if a claim needs to be made.

Might be worth him getting to sign something to say he is taking it on the understanding it has no MOT in the event he tries a fast one should an accident occur.
 
Thinking about it now, I am going to have to find the time to get the MOT done because it will be much easier incase anything does happen. Its only £45 anyway (Im pretty sure it will sail through). Finding the time is the hard bit....
 
if you don't get the mot done you'd have to declair it SORN which takes seconds and is painless - however you would have to keep it off the road till its MOT'd somewhere else, and the owner of the vehical at the time (re-gardless of if he realises or not) can be fined for driving on a road without one.

I wonder if he could book it in for a ROI MOT and use that as the excuse - your legally aloud to drive a car to a booked mot although your proberbly pushing it if its not in the same country
 
you have to declare a car sorn if it runs out of tax, not MOT.
booking a car in for a ROI mot will make no difference if you get caught driving with no MOT.

If you are gonna go to the trouble of getting it mot'd then you should have done that before putting the car up for sale. cars with a long mot are worth more than cars with no MOT.

also just get the buyer to sign a letter saying he bought the car and you will be fine. it's totally his responsibility.

don't assume your car will sail though an MOT. unless you are a competant DIY mechanic and you've given it a good look over already.
