I was looking at a new motor, when I've checked the MOT history it shows its failed an MOT on 3rd September with 1 dangerous and 9 major defects but shows it still has a valid MOT until November.

Does the failed MOT not supercede the previous one?

Can a car be sold with dangerous and major defects?

Yeah it's not even worth a look, was just wondering how it would be legal to sell it

Do not drive until repaired (dangerous defects):
  • Offside Front Brake hose connection leaking on a hydraulic braking system (1.1.12 (c) (ii))
Repair immediately (major defects):
  • Nearside Front Headlamp not working on dipped beam (4.1.1 (a) (ii))
  • Offside Front Headlamp aim projected beam image is obviously incorrect (4.1.2 (c))
  • Nearside Front Position lamp not working (4.2.1 (a) (ii))
  • Exhaust Lambda reading after 2nd fast idle outside specified limits (8.2.1.2 (c))
  • Nearside Front Road wheel fixing missing (5.2.1 (a) (i))
  • Offside Front Road wheel fixing missing (5.2.1 (a) (i))
  • Nearside Rear Road wheel fixing missing (5.2.1 (a) (i))
  • Offside Rear Road wheel fixing missing (5.2.1 (a) (i))
  • Exhaust has a major leak of exhaust gases (6.1.2 (a))
Monitor and repair if necessary (advisories):
  • engine cover fitted
  • under trays fitted
  • Coolant leak ()

It would be legal to sell it as the mot is valid still, and it's legal to sell cars without mots

I'm not sure the early MOT fail necessarily supercedes the old one but it's not legal to drive a car that has been deemed to have a dangerous fault.

Whether they've fixed that fault is another matter.

It won't be legal for a trade seller to move it on, their cars must be roadworthy. Although the existing MOT would still be valid if the car had major failures, because it had a dangerous one it's no longer driveable on the road.
