my 360 freezes

hi guys I bought a 360 around in june and havent played on it for more than 10 hours in total due to a new job/gf/cars/going out etc so when i sat down tuesday night to watch my godfather collection on dvd and godfather 1's disc was missing :(
I thought I would have a game of perfect dark so i put it on and every time I got to some FMV the console totally froze so i skipped all this and then it froze in-game so i had a look at my disc there were a few scratches but nothing major. so i cleaned it and had the same problem. I put fifa on and the outside edge of the disc looks white like its really heavilly scratched and it wouldnt load past the title screen so i deleted my fifa settings on the hard drive and it seems to work but then when i reset the console the same happens.
so i i removed the hard drive and put perfect dark back on which now works. my conclusion is my hard drive is goosed. I bought the console and games form GAME and I've lost my reciept but I did get the points on my GAME card.
I spoke to microsoft and the guy gave me some crap that I must have moved the console while it was on. I havent moved it for 3 months! whats the best thing for me to do? can I just take it back to game and get a new one? do I have to have the reciept? do I just take the console itself or do I have to put everything back in the box like the controller, wires etc? I very rarely have a day off work so I need to sort this in the next couple of hours.
 
Seeing as you've such a short window to do all this, here's what I'd do personally...

Ring Game up, ask if they have a machine in stock. Say no more, hang up and say you'll be in shortly.

Package the system up, EVERYTHING (except the hard drive), make everything look like it's just bought.

Go down to game, with your receipt, tell them you purchased the console and it's now faulty and under their own terms and conditions (and your rights), you'd like one of the new machines that you've already enquired about.

There's no luck involved at all, you are entitled to a new one if the machine is proven to be faulty in the shop, and you'll probably walk away with a new one within 10mins.

He hasn't got a receipt, and why does he have such a short Window? He bought it in June and it's 12 months warranty with Game also.
I'm sure they'd be able to tell the purchase date from the points on his Game card though.
 
When I bought my 360 from Game about 2 weeks ago I signed up for a points card and the guy said that one of the benefits is that it acts as an electronic reciept incase I do loose the original paper receipt....if that helps :)
