Hello,

Got a problem with my Xbox 360, keeps cracking my games. Cracked 3 so far :( PGR 3 dont even work anymore and Need For Speed and Ridge Racer both have small cracks.

I need to get the system replaced :(

I brought the system from GAME back in Jan and still have the reciept and box.

Should i just take it back to GAME on saturday and get them to replace it ? or should i be calling up Xbox Support and waiting 10 days for a replacement ?

Will GAME even replace it or will they just tell me to call Xbox Support ?

Thanks Ben

Wow,, hows it possible for it to crack a disk?? ive thrown disks at a wall before and they havnt cracked,,lol

I would phone microsoft, I got mine from game and when it busted I didnt bother taking it back there as I knew they would get confused as to what to do,, microsoft on the other hand were pretty spot on,, took about a week for a replacement,, a little tip, dont sent your powerpack cos they are bound to forget to send it back..

I took mine back to Game with the receipt different store too, just the console, HD and the power supply, they brought out another premium from the stock room and tested it to find that the drive wasn't ejecting as it should, so they brought out another one and it worked great, put it all back in my box and off i went.

Better than waiting awhile with Microsoft and couriers etc.

This has been covered a fair few times.
Under the sale of goods act you are entitled to refund or replacement.
Your contract is with the retailer - that is GAME not microsoft.
GAME are obliged under your statutory rights to refund or replace the console for you.

In my experience GAME store managers do not know anything about statutory consumer rights or the sale of goods act and in my case it escalated to them calling the police when I refused to leave the store.
I eventually got a replacement console.

If they tell you to replace it via microsoft then they are talking out of their backsides. Your contract is with game.

You might want to read, digest and understand this link before you go to game. You might want to take a copy with you and their headoffice number as well.

THE LAW :

Took my console into game last week.

They tried to send me off to microsoft, but I was stubborn and a guy was buying a 360 and 6 games next to me and I was returning one, eventually I got one though.

Easier to go to them, but print out the info on the link above first. :)

Dont argue with this man, he got arrested taking one back!! lol

Game are ridiculous. The manager called security on me because I refused to leave with out a replacement so 4 of them arrived and asked me to leave. Obviously they can't actually touch me so I just refused to leave and carried on making my opinion on the managers returns policy known. So they called the police. Mental.

Apparently he thought I was going to headbutt him. As if I'd do that (infront of my daughter ;) )

hahaha go on VIRII you tell them fools at game :p

I can just imagine VIRII in a black suite, shades and carrying a briefcase accompanying people into shops who want refunds.

A new line of work perhaps? :p

All I had to do was quote the link he has in his post and pull it out of my pocket and the one at Worcester gave in. :p

How they do not know the returns laws amazes me, you should sue for compensation of emotional distress of the whole experience. ;)

HAHAHAH We are going to have a new trend of Judge Judy cases now! 'I am sueing you for emotional distress after I got fed up with a game and had to return it!'

I thought security guards were perfectly entitled to escort you off what is private property, seen it many a time on non fictional tv, personally given your daughter was in tow i would have tried another store, no offense :)

I was calm and rational, my speaking voicewas loud enough for others to overhear.
3 old chaps and a young one probably did not feel comfortable with trying to move me physically.
They know and I know that trying it physically would have created far more of a scene, probably more than a little injury to them and risk me bringing up an assault case. Don't forget I can break into your house stub my toe and sue you for it....
If my daughter had been distressed I'd have gone straight away. She actually moaned that she was bored.
