Neighbour issuing parking tickets!

So, there is a chap in my street who has been issuing parking tickets when people park outside his house on the road (no yellow lines)

He lives across the road from me, so I see the station parkers drop their cars there and he will sure enough drop an official looking ticket on the cars. Not seen what people actually do with them when they return, but I am fairly sure they are unenforceable, as he has no way of knowing who the owners are so could never chase for payment.

The houses here seem to have boundaries that go out over the pavement to the middle of the road at the front. Mine is also the same.

So based on this, the people are parking on "his" land. He has big signs up on his wall, warning of parking tickets/etc.

He seems like a very angry man. He has shouted at me before from his window for some bizarre reason. I just wanted to know where these ticketed drivers stand legally. I have been asked a couple of times as I walk up to my house if I know anything about the tickets.

They rarely get in the way. It's really not a big deal. There are dropped kerbs and they never block these, so the driveway entries are clear. I have two such areas directly outside my house on "my land" and when someone does park there, I still have full access to my drive, as does he.
Will try and get a picture of his signs and the parking spots later.
 
The road ownership thing is odd. Basically the borders of our property appear to hit the centre line of the road from our boundary lines.

So each house seems to "own" a small rectangular patch of pavement and road.

We are not responsible for the upkeep of the road though, so it seems to be a very unusual situation. The houses are all post war, so it's not a new estate, and it's ex military ground/housing.

Our house was purchased from the army directly by the previous owners.

So it may be a hangover from when the road was MOD owned?
 
So you're responsible for the upkeep of the road as a collection of houses on your street? No?

Therefore your "apparent" boundary is irrelevant and he has no jurisdiction or enforcement of fines or otherwise.

Similar to where I park, one of the residents insists on putting a cone outside their house. I just move it.

I know, hence me making the point that it's clearly a hangover of some sort from before the land was taken over from the MOD.
It has no real meaning. However, my neighbour thinks otherwise! He clearly has a bit of paper telling him it's his, so he is trying to enforce it :)

I had a few minutes spare this afternoon and called the council.

They are VERY interested, the road is council managed and they think he is misinterpreting the boundary.

They have given me a reference number, and have claimed they will do a "drive by" to check the signs and check on the legality of what he is doing.

Watch this space!
 
ah you're right, I guess I learned something new today, I thought when roads were adopted by the council the ownership changed

yup, this guy has no rights to issue tickets if the council has adopted it then



nice one :D

am actually quite interested in how this turns out, presumably he's going to be told to get rid of the sign rather quickly

I am quite interested to see if any "tickets" he issued in the past will have to be refunded if they find him in the wrong!

Council have told me I have to take it up with local council, not the county council. They then said that if this is not covered by them, I would have to speak to the Police.
Will get on to the local guys asap.
 
He has now taken to parking his own car outside his house in the disputed location, dead centre, to stop anyone else parking there.
I believe this is because he has been told he can no longer give out tickets by the Parish Counail.
 
The best part of it is that the council guy parked his car in the disputed spaces :D

He has now taken him inside to "let me show you the deeds"...

Apparently his house (and a few others in the street, mine too apparently) are "special" meaning we own the road.

It seems this has come to a head because some council official was told to use this road for parking by the Parish, and her unmarked car was ticketed.

It would appear my reporting was simply a timely coincidence. Although the parish council did chase me up for an email reporting the issue on Friday.
