New Bluray "DRM" causing problems?

I'm told that my copy of Fantastic4 should be here once the postal strike finishes. I'll post an update as to whether it really does have problems with my BDP1000.
 
The strange thing is that some people with the same equipment dont have issues at all

(people using PS3 with the same the two discs without an issue on avforums)

Maybe some of the latest firmware updates on the PS3 have fixed the issue?
Only older firmware PS3s have the problem?
