Ok, cut a long story short my BRAND NEW Vauxhall Corsa i recieved two weeks ago has broken down on me twice in the last 4 days, both occassions needing an AA recovery back to the Vauxhall dealer.

The first time the water pump and radiator needed replacing, this time it looks like something is up with the fluid system.

Now as you can imagine im livid, i want to give the car back to them and demand my deposit back (followed by me cancelling the direct debit).

What are my rights to do this? I have no confidence in the car and want rid!

Buying a Corsa on finance was your first mistake ;)

The Consumer Credit Act only gives you a 7 day cooling off period, but in your contract it might have given you longer to refuse the goods? Doubt it though.

Looks like you are stuck with it, I think (but I could be wrong) they only have to repair it if it isn't fit for purpose.

If it is at the customers discretion then yeah, but I can't remember if it is or not. If it isn't, I cant see them giving him a new one instead of repairing it.

You have the right to return it to the dealer for refund/cancellation. The more you let them mess about with it, the less chance you have of successfully getting your money back. Each time you allow it to be fixed you are effectively saying that you think this is acceptable. Either give it back or put up and shut up, legally. See the consumer help websites or the CAB for the details.

Harsh. But fair.

My in-laws bought a brand new Citroen C1 last year, it ground to a halt after a month or so - the cause, there was not a drop of oil in the engine.

Although they requested that they didn't want the car back, but a new replacement, Citroen wouldnt oblige and gave them back the repaired car. Touch wood it has been fine since, so you may be okay once the teething problems are sorted, although i know it does knock your confidence in the car.

Thats pretty unlucky :(

We have a fleet of 3 meganes, 1 scenic and a ford focus. All are 07> and all have been returned to the dealer with pretty serious faults (complete power steering failure, oil pump, oil pipes, coolant tank to name but a few) in my eyes considering they are brand new cars.

One of the meganes went back to the dealer who then basically said it wasn't built properly (oil pump failure) at the factory!

Luckily my 57 megane seem's alright (touch wood) mind you i've only done 4500 miles in it, getting a bit scared!

They got car of the year...

So did the Pug 307

Oh wait i own one of them and they are terrible , this car was also rated the 2nd worst car on the top gear survey!!

Car of the year must be fixed!

Car of the Year isn't based on reliability though.

A "Car of the Year" could disintegrate after 12 months and the judges wouldn't care less.

You only have to look at the number of Fiats, Fords, Renaults and Peugeots in the rankings...

How many times have BMW won it when the cars they produce at the best or at the very least, one of the best in their sectors.

Exactly.

Doubtful. You have to give them adequate chance to rectify the fault.

If it's a small or cosmetic fault, yes, but stranding him twice in its first two weeks and requiring a replacement radiator and water pump (which sounds to me like the garage don't know what's up with it) is what I would call a considerable defect, rendering the car unfit for purpose. I would try to get a replacement at least.
