New DVD drive issue

Hi all. I wonder if someone in retail could clarify something please? I bought a DVD rom a couple of months ago. Since then, My STALKER DVD started to have two cracks radiating from the central spindle. I took the game back, thinking it was caused by the slightly dodgy method for clipping it back into its holder (I have the tin box version). It was swapped without issue.

Now the thing is, it has also started to happen to my C&C DVD, which stays in the drive, not in the case, the case is also a soft plastic, unlike the brittle Stalker one. So it can only be the drive causing the issue (I am VERY careful with my Disks).

Where do I stand? Should the shop (NOT OC) reimburse me for my game as they sold me a defective product? Or am I stuck with a broken game, which I love to play and now cant?
 
It sounds very odd but maybe the spindal is out of line when the draw goes in.. What make is it?

For what DVD drives cost nowadays, replace it!!! Then goto to the manufacturers website for the RMA details. Have the serial number handy.

It should tell you if it's still in warrantee straight away. If so, get an RMA number and the postal instructions.. You'll get a replacement but don't hold your breath.. this can take months which is why I said buy a replacement. If it comes back, it will be a new one, in which case you can sell it to cover the cost.

If it's out of warrantee.. well you need a new one anyway..
 
Thanks for the reply. The drive is only 3 months old, the shop swapped the drive. When I got the "new" drive home, I found it contained a cd with pirated software on it!

Anyway, they wont pay for the game - yet. I will be taking this drive back with their pirated software tomorrow for an explanation from the manager.

Good for you.. hold as a bribe and get a refund on your CD.. Incidently, I'm not sure of the laws now, but years ago a stood on my RTCW CD and it snapped. I got in touch with the publishers and they replaced the CD FOC. The reason for this is that you don't buy or own the CD and/or its contents. You only buy the license to use it so as long as you have a legit license/code, they are normally happy to send you a replacement disk.. but as I said, things may have changed.
