NIP - 17 Days and the Xmas period

Hello all,

Quick question really.... does the 17 day rule (14 + 3 days to allow for postage) still apply for the authorities to send a NIP out over the Xmas period?

I fear I may of been caught by a mobile speed camera on Saturday 9th December, which would mean the 17th day is the 26th December (Boxing Day).

I'm not turning this in to a 'just take it on the chin and accept it' thread, I just want to know the facts, as the 18th December is the last day for postage before the Xmas break.

I would answer - but I switched off when you wrote 'would have' .

Haha just kidding. As far as I know as long as the post mark is within the 14 day period you can still be prosecuted. Just pay the fixed penalty then you can't be convicted.

Thats correct they have got to send you a NIP within 14 days, but its go to be sent out in that time period. Slow post etc doesnt count, So as long as the NIP is posted out within 14days then you cant get around it.
 
The NIP must be received within 14 days (including the postage time) and must be sent with the intention that you will receive it within that time period.

ie if it was sent after 7 days but the post took 9 to reach you then it would still be valid, if on the other hand it was sent out on the twelth day and the following days were holidays and the such (ie a Sunday, Christmas day and Boxing day) then you could discount it as there is no way that you could have received it within the allotted time period.
 
I imagine that if there was a camera out then its because they intend to prosecute even considering the season, i doubt they'd sit there to have a picnic on the side of the road given that its also reasonable to assume that if they do they will also know when it needs to be sent for them to deliver their message of christmas kick in the teeth*

i cant imagine they will be more lenient either, using winter as an excuse because of the possibility of slippery conditions only backs up their case

just have to hope you didn't get caught :(

* actually now i think about it, if they posted you a box with a boot in it that springs out and actually kicks you in the teeth you'd probably be less likely to speed, they just wouldn't make any money that way

im going to be quite worried about opening my christmas presents now :P i think ill have to duck each time just in case ;)
